S T A T E O F N E W Y O R K ________________________________________________________________________ 8204 2009-2010 Regular Sessions I N A S S E M B L Y May 7, 2009 ___________ Introduced by M. of A. MAGEE -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to allowing firefighters, members of a fire company auxiliary and members of a volunteer ambulance service to solicit funds on roadways THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 1157 of the vehicle and traffic law, subdivision (c) as added by chapter 510 of the laws of 1967, is amended to read as follows: S 1157. Pedestrians soliciting rides, or business. 1. (a) No person shall stand in a roadway for the purpose of soliciting a ride, or to solicit from or sell to an occupant of any vehicle. (b) No person shall stand on or in proximity to a street or highway for the purpose of soliciting the watching or guarding of any vehicle while parked or about to be parked on a street or highway. (c) No person shall occupy any part of a state highway, except in a city or village, in any manner for the purpose of selling or soliciting. 2. THIS SECTION SHALL NOT APPLY TO FIREFIGHTERS, MEMBERS OF A FIRE COMPANY AUXILIARY AND MEMBERS OF A VOLUNTEER AMBULANCE SERVICE WHO ARE PERFORMING FUND RAISING ACTIVITIES FOR ANY VOLUNTEER FIRE COMPANY OR VOLUNTEER AMBULANCE SERVICE ON ROADWAYS IN MUNICIPALITIES WHERE POSTED SPEED LIMITS ARE THIRTY MILES PER HOUR OR LESS. FOR PURPOSES OF THIS SECTION, THE MUNICIPALITY IN WHICH THE ROADWAY IS LOCATED SHALL LIMIT THE NUMBER OF DAYS AND HOURS THAT SUCH FUND RAISING ACTIVITIES MAY BE PERFORMED AND SHALL REQUIRE SUCH SAFETY PRECAUTIONS AS THEY DEEM APPRO- PRIATE AND NECESSARY. FOR PURPOSES OF THIS SUBDIVISION, THE TERM "MUNI- CIPALITY" SHALL MEAN A COUNTY, TOWN, CITY OR VILLAGE. S 2. This act shall take effect immediately.
