BILL NUMBER:A8861 TITLE OF BILL: An act to amend the social services law, in relation to withholding of certain room and board payments if the condition is dangerous, hazardous or detrimental to life or health PURPOSE: Authorizes public welfare officials to withhold the payment of room and board in any case where there is knowledge that an outstanding violation of law exists in respect to the building containing the hous- ing accommodations occupied by the persons entitled to such assistance which is dangerous, hazardous or detrimental to life or health. It further provides that in no event shall such public welfare official withhold any payment for food to such person. SUMMARY OF PROVISIONS:Subdivision 2 of section 143-b of the social services law; as added by Chapter 997 of the Laws of 1962, is amended to authorize public welfare officials to withhold certain room and board payments in any case that there is knowledge that an outstanding violation of law exists in respect to the building containing the hous- ing accommodations occupied by the persons entitled to such assistance which is dangerous, hazardous or detrimental to life or health; provided, however, that in no event shall such public welfare official withhold any payment for food to such person. THIELE, ALESSI, RAMOS -- read once and referred to the Committee on Social Services AN ACT to amend the social services law, in relation to withholding of certain room and board payments if the condition is dangerous, hazard- ous or detrimental to life or health THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 143-b of the social services law, as added by chapter 997 of the laws of 1962, is amended to read as follows: 2. Every public welfare official shall have power to and may withhold the payment of any such rent OR ROOM AND BOARD in any case where he OR SHE has knowledge that there exists or there is outstanding any violation of law in respect to the building containing the housing accommodations occupied by the person entitled to such assistance which is dangerous, hazardous or detrimental to life or health; PROVIDED, HOWEVER, THAT IN NO EVENT SHALL SUCH PUBLIC WELFARE OFFICIAL WITHHOLD ANY PAYMENT FOR FOOD TO SUCH PERSON. A report of each such violation shall be made to the appropriate public welfare department by the appro- priate department or agency having jurisdiction over violations. S 2.
