                                BILL NUMBER:A8898

TITLE  OF BILL:  An act in relation to the implementation of the terms
of a written agreement between the city university of New York,  as  a
public   employer,   and   its  employee  organization:  international
brotherhood of teamsters local 237; and making appropriations therefor

Purpose:   This  bill  would  implement  the  terms  of  a  collective
bargaining  agreement  between the City University of New York (CUNY),
as a public employer, and its employee organization: the International
Brotherhood of Teamsters Local 237 (IBT 237).

Summary of provisions:  Section 1 of this bill would authorize CUNY to
implement the terms of the  written  collective  bargaining  agreement
with  IBT  237  in  effect for the period from August 18, 2006 through
September 17, 2009.

Section 2 of this bill would provide that  the  salary  increases  and
benefit  modifications authorized under section 1 of the bill would be
implemented contingent upon certification by the CUNY Chancellor,  the
Commissioner  of  the  New York City Office of Labor Relations and the
Director of the New York State Governor's Office of Employee Relations
to the State Director of the Budget and State  Comptroller  that  such
collective  bargaining  agreement has been fully executed and ratified
by bargaining unit members and approved by the CUNY board of trustees.

Section 3 of this bill appropriates $5,330,000 to the credit of CUNY's
Fiduciary Fund for expenses already accrued, or to accrue  after  July
1,  2006, to implement the terms of the agreement described in section
1 of this bill.

Section 4 of this bill appropriates $4.6 million out of moneys in  the
General  Fund to the credit of the local assistance account to support
the salary increases and benefit modifications authorized through  the
end of the 2008-09 academic year.

Section  5 of the bill provides that it would be effective immediately
and be deemed to have been in full force and effect upon  approval  of
the  collective bargaining agreement by the CUNY Board of Trustees and
upon ratification of such agreement by the employee organization.

Existing law:  Chapter 135 of the Laws of 2005 implemented  the  terms
of  the  agreement  between  CUNY and IBT 237 for the period July 2002
through June 30, 2006.

Statement in support:    This  bill  is  necessary  to  implement  the
collective bargaining agreement between CUNY and IBT 237 in effect for
the  period  from August 18, 2006 through September 17, 2009. It would
ensure the payment of negotiated salary increases and other aspects of
such collective bargaining agreement between the parties.

Budget implications:  This bill includes a $5.3 million Fiduciary Fund
appropriation and a  $4.6  million  General  Fund  Aid  to  Localities
appropriation  to  support  the  retroactive and current year costs of
salary increases and benefit modifications included in the  collective
bargaining  agreement for the period August 18, 2006 through September


17, 2009. The General Fund Aid to Localities appropriation  reimburses
the City University of New York for pre-financing these costs.

Effective  date:  This bill would take effect immediately and would be
deemed to have been in full force and  effect  upon  approval  of  the
written   agreement  by  the  board  of  trustees  of  CUNY  and  upon
ratification of the written agreement by the employee organization.

AN ACT in relation to the implementation  of  the  terms  of  a  written
  agreement between the city university of New York, as a public employ-
  er,  and its employee organization: international brotherhood of team-
  sters local 237; and making appropriations therefor

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  city  university of New York is hereby authorized to
implement the terms of the written agreement between the city university
of New York, as a public employer, and its  employee  organization,  the
international  brotherhood  of  teamsters  local  237, in effect for the
period from August 18, 2006 through September 17, 2009.
  S 2. The salary increases and benefit modifications provided  in  this
agreement  for  employees of the city university of New York pursuant to
section one of this act shall not be implemented until the chancellor of
the city university of New York, the commissioner of the New  York  city
office  of labor relations and the director of employee relations of the
state of New York shall have delivered to the director of the budget and
the comptroller of the state of New York a certificate that there is  in
effect  a  collective bargaining agreement fully executed in writing and
ratified by the bargaining unit members and approved  by  the  board  of
trustees  of  the  city  university  of  New York which provide for such
increases and modifications.
  S 3. For the city fiscal year beginning July 1, 2008, the sum of  five
million  three  hundred thirty thousand dollars ($5,330,000), or so much
thereof as may be necessary, is hereby appropriated to the credit of the
fiduciary fund - city university of New York  senior  college  operating
fund  to  implement  the terms of the written agreement between the city
university and the bargaining unit described in section one of this act.
The moneys hereby appropriated shall be for expenses already accrued, or

to accrue after July 1, 2006. No money shall be available  for  expendi-
ture  from  this appropriation until a certificate of approval of avail-
ability has been issued by the director of the budget and a copy of such
certificate or any amendment thereto has been filed with the state comp-
troller,  the  chairman of the senate finance committee and the chairman
of the assembly ways and means committee.
  S 4. The sum of four million five hundred ninety-six thousand  dollars
($4,596,000),  or  so much thereof as may be necessary, is hereby appro-
priated out of any moneys in the state treasury in the general  fund  to
the  credit  of the local assistance account for financial assistance to
the city of New York to be paid during the city  fiscal  year  beginning
July  1, 2008. This sum is available for costs attributable to the writ-
ten agreement between the city university of New York and  its  employee
organization applicable to the city fiscal years beginning July 1, 2006;
July 1, 2007; and July 1, 2008.
  S  5.  This  act  shall take effect immediately and shall be deemed to
have been in full force and effect upon approval of the  written  agree-
ment  by  the  board  of trustees of the city university of New York and
upon ratification of the written agreement by the employee organization.
