BILL NUMBER: S1046 TITLE OF BILL : An act to amend the education law, in relation to administrative flexibility of the state university construction fund and the development of university-related economic development facilities PURPOSE : This bill amends the definition of university-related economic development facilities set forth in section 372-a of the Education Law to include projects which will serve the University community, provided they will not displace private sector development. In addition, university-related economic development facilities projects are authorized on newly acquired property (or on property for which a University ground lease is already authorized). All university-related economic development projects are developed without State appropriated funds. Finally, the bill would provide the Fund with the design/build method of project delivery. SUMMARY OF PROVISIONS : Section 2 amends section 372-a of the Education Law, which authorizes university-related economic development project, to make it clear that such projects may include facilities to serve the University

LAVALLE, ONORATO, PARKER, VOLKER -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to administrative flexi- bility of the state university construction fund and the development of university-related economic development facilities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The opening paragraph of subdivision 1 and subdivision 2 of section 372-a of the education law, as added by chapter 624 of the laws of 1999 and paragraph a of subdivision 2 as amended by chapter 609 of the laws of 2003, are amended to read as follows: Notwithstanding subdivisions one through six and eight through ten of section three hundred seventy-six of this article, the provisions of this section shall apply to the fund when it acts pursuant to the authorization under this section. Pursuant to the authorization in this section and approval by the trustees of the university, the fund may acquire, design, construct, reconstruct, rehabilitate, improve, lease, manage and/or operate university-related economic development facili- ties. University-related economic development facilities, as used in this chapter, shall mean FACILITIES AUTHORIZED BY SUBDIVISION TWO OF THIS SECTION WHICH ARE INTENDED TO SERVE THE UNIVERSITY COMMUNITY OR facilities for research, development and commercial enterprises dealing in products and/or services related to the mission or academic special- ties of the campus associated with such facilities, or dealing in support products or services for such enterprises which will have a significant economic benefit. Consistent with such authorization, the state university trustees are authorized to enter into contracts or leases for lands and facilities authorized in subdivision two of this section. Such leases or contracts shall be for the development, construction, and operation of such facilities by the fund.
