BILL NUMBER: S1217 TITLE OF BILL : An act to amend the uniform city court act, in relation to providing for an additional city court judge for the city of Buffalo; relating to the establishment of an alternative youth criminal court whereby the additional city court judge presides over such court PURPOSE OF BILL : The proposed legislation aims·to increase the statutory number of city court judges for the City of Buffalo. This legislative proposal will create one additional judge for the City of Buffalo court system. SUMMARY OF PROVISIONS : This bill amends paragraph 7 of subsection 2104 of the Uniform City Court Act, as added by chapter 397 of the laws of 1988, in order to create one additional full-time judgeship for the City of Buffalo. The bill will establish fourteen full-time judgeships for the City of Buffalo (currently there are only 13 full-time judgeships). JUSTIFICATION : The proposed legislation aims to address and resolve the judicial issues that are currently plaguing the Buffalo City Court system. By creating one additional judgeship, this legislation helps the Buffalo City Courts to meet their operational needs. The majority increase in

THOMPSON, ONORATO -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary AN ACT to amend the uniform city court act, in relation to providing for an additional city court judge for the city of Buffalo; relating to the establishment of an alternative youth criminal court whereby the additional city court judge presides over such court THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any general or special law, rule or regu- lation to the contrary, the city of Buffalo is hereby authorized to create a pilot program establishing an alternative youth criminal court. Juveniles, age sixteen through eighteen, that would otherwise be prose- cuted in city court for offenses of less than felony grade, committed within such city, shall be prosecuted and sentenced in the alternative youth criminal court. S 2. Paragraph 7 of subdivision (d) of section 2104 of the uniform city court act, as amended by chapter 493 of the laws of 2006, is amended to read as follows: 7 Buffalo, [thirteen] FOURTEEN full-time; S 3. The full-time city court judge added by section two of this act shall serve in the capacity as the alternative youth criminal court judge, established by section one of this act. S 4. This act shall take effect January 1, 2011; provided, however that the additional city court judge provided for in section two of this act, shall first be elected at the general election to be held in Novem- ber 2009 and shall first take office January 1, 2010. Effective imme- diately, the office of court administration shall promulgate rules and regulations necessary for the implementation of this act on its effec- tive date.
