BILL NUMBER: S1413 TITLE OF BILL : An act to amend the real property tax law, in relation to subjecting certain state lands to real property taxation PURPOSE : The purpose of this legislation is to allow for the taxation of state-owned land, acquired for a public use, exclusive of the improvements erected thereon, in the town of Arkwright, County of Chautauqua. SUMMARY OF PROVISIONS : Section 532 of the real property tax law is amended and a new subdivision (k) is added. JUSTIFICATION : Currently, there are approximately 3,000 acres in the town of Arkwright which are owned by the State of New York and set aside for public use. These lands fall under the Department of Environmental Conservation, Division of Wildlife, and as such are not subject to local taxes. The economy of small towns such as Arkwright may be adversely affected when a large portion of town land is taken from the tax base.

YOUNG -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the real property tax law, in relation to subjecting certain state lands to real property taxation THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 532 of the real property tax law is amended by adding a new subdivision (k) to read as follows: (K) ALL LANDS IN THE TOWN OF ARKWRIGHT, COUNTY OF CHAUTAUQUA, ACQUIRED FOR A PUBLIC USE BY THE STATE, EXCLUSIVE OF THE IMPROVEMENTS ERECTED THEREON BY THE STATE. S 2. This act shall take effect immediately and shall apply to assess- ment rolls prepared on the basis of taxable status dates occurring on and after the date on which this act shall have become a law.
