BILL NUMBER: S152 TITLE OF BILL : An act to amend the education law, in relation to requiring the usage of seat safety belts by passengers of school buses which are equipped with such belts PURPOSE : This bill seeks to increase the safety of children while they are being transported by school bus, by requiring the use of seat belts in buses so equipped. SUMMARY OF PROVISIONS : Section 1 would amend subdivision 1 of §3623 of the Education law to require all passengers on school buses equipped with seat belts to use them, and to require a sign to be posted on all school buses with seat belts that would notify passengers of the seat belt use requirement. The sign would be provided by the state Department of Transportation. Section 2 would correct references in §3635-a of the Education law so that local school boards may provide for the installation of school seat safety belts; upon such installation, use of the belts would be required.

FUSCHILLO -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to requiring the usage of seat safety belts by passengers of school buses which are equipped with such belts THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 3623 of the education law, as amended by chapter 474 of the laws of 1996, is amended to read as follows: 1. a. NO SCHOOL BUS, AS THAT TERM IS DEFINED IN SECTION ONE HUNDRED FORTY-TWO OF THE VEHICLE AND TRAFFIC LAW, WHICH IS EQUIPPED WITH SEAT SAFETY BELTS AS SPECIFIED IN SUBDIVISION FIVE OF SECTION THREE HUNDRED EIGHTY-THREE OF THE VEHICLE AND TRAFFIC LAW AND SECTION THIRTY-SIX HUNDRED THIRTY-FIVE-A OF THIS ARTICLE, SHALL BE OPERATED UNLESS ALL PASSENGERS ARE RESTRAINED BY A SEAT SAFETY BELT. B. ON EVERY SCHOOL BUS EQUIPPED WITH SEAT SAFETY BELTS, AS SPECIFIED IN SUBDIVISION FIVE OF SECTION THREE HUNDRED EIGHTY-THREE OF THE VEHICLE AND TRAFFIC LAW AND SECTION THIRTY-SIX HUNDRED THIRTY-FIVE-A OF THIS ARTICLE, THE COMMISSIONER OF TRANSPORTATION SHALL POST AND MAINTAIN IN PLAIN VIEW OF THE PASSENGERS A CONSPICUOUS WARNING SIGN READING "NEW YORK STATE LAW REQUIRES EVERY PASSENGER OF THIS SCHOOL BUS TO WEAR A SEATBELT WHILE THIS BUS IS IN OPERATION". C. The commissioner of transportation in consultation with the commis- sioner shall adopt, promulgate and enforce rules, standards and specifi- cations regulating and controlling the efficiency and equipment of school buses used to transport pupils, with particular regard to the safety and convenience of such pupils and the suitability and adaptabil- ity of such school buses to the requirements of the school district. THE COMMISSIONER OF TRANSPORTATION SHALL BEAR ALL COSTS ASSOCIATED WITH EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
