2009-S159 (ACTIVE) - Summary
Provides that for the purpose of eliminating the financial burden of two fares on the commuter, free transfers shall be given by the New York City transit authority from the terminal point of all subway lines to all intersecting omnibus lines and from the terminal point of all omnibus lines to all intersecting subway lines operated by such authority.

BILL NUMBER: S159 TITLE OF BILL : An act to amend the public authorities law, in relation to free transfers from the terminal points of subway lines to omnibus lines and from the terminal points of omnibus lines to subway lines operated by the New York city transit authority PURPOSE/SUMMARY OF PROVISIONS : This bill will require that free transfers will be given from all terminal points of subway lines to omnibus lines and from terminal omnibus points to all subway lines. This bill will amend subdivision one of section twelve hundred five of the public authorities law. JUSTIFICATION : Throughout New York City, uniformity of the fare burden must prevail. Correspondingly, since uniformity cannot be achieved through practical means, provisions must be made to allow commutation without the financial burden of two fares. In addition, this bill would promote the general use of mass transit, with subsequent favorable effects on air pollution levels and traffic congestion in the city. KRUGER -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the public authorities law, in relation to free trans- fers from the terminal points of subway lines to omnibus lines and from the terminal points of omnibus lines to subway lines operated by the New York city transit authority THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 1205 of the public authorities law, as amended by chapter 717 of the laws of 1967, is amended to read as follows: 1. Notwithstanding the provisions of any other law, the terms of any contract or franchise, the authority shall have the power at all times to fix or adjust the rate or rates of fare to be charged for the use of any transit facility operated by the authority as may in the judgment of the authority be necessary to maintain the operations of the authority on a self-sustaining basis, PROVIDED, HOWEVER, THAT WHATEVER THE RATE OF FARE IS FIXED AT, AND FOR THE PURPOSE OF ELIMINATING THE FINANCIAL BURDEN OF TWO FARES ON THE COMMUTER, FREE TRANSFERS SHALL BE GIVEN FROM THE TERMINAL POINT OF ALL SUBWAY LINES TO ALL INTERSECTING OMNIBUS LINES AND FROM THE TERMINAL POINT OF ALL OMNIBUS LINES TO ALL INTERSECTING SUBWAY LINES OPERATED BY THE AUTHORITY. The operations of the authority shall be deemed to be on a self-sustaining basis, as required by this title, when the authority is able to pay from revenue, from any funds granted or transferred to the authority pursuant to any provision of law, including funds granted pursuant to the provisions of section nine- ty-eight-b of the general municipal law, and from any other funds actu- ally available to the authority, including the proceeds of borrowings for working capital purposes, the expenses of operation of the authority as the same shall become due. S 2. This act shall take effect on the sixtieth day after it shall have become a law.
