Permits wineries to include on the label of a wine bottle, a statement stating that the wine contains antioxidants, provided that such wine is not sold, offered for sale, shipped, delivered for shipment or otherwise introduced into commerce outside the state of New York.

BILL NUMBER: S1611 TITLE OF BILL : An act to amend the alcoholic beverage control law, in relation to allowing wine labels to contain information regarding antioxidants PURPOSE : Permits a winery to include a statement regarding antioxidants on a wine bottle label if wine is not introduced for interstate or foreign commerce. SUMMARY OF PROVISIONS : Adds a new Section 86 to the Alcoholic Beverage Control Law. JUSTIFICATION : The New York wine/grape industry provides a significant contribution to the State's agriculture and agribusiness efforts. The state's 203 wineries produce and sell 40 million gallons of wine annually, with gross sales of over $1 Billion. These wineries crush an average of 70,000 tons of grapes purchased from over 1,000 growers (The New York Wine Course and Reference - 2004). The American Heart Association has stated that moderate wine consumption provides a potentially sizeable benefit to one's cardiovascular health. In addition, a report published in the Journal

VALESKY -- read twice and ordered printed, and when printed to be committed to the Committee on Commerce, Economic Devel- opment and Small Business AN ACT to amend the alcoholic beverage control law, in relation to allowing wine labels to contain information regarding antioxidants THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The alcoholic beverage control law is amended by adding a new section 86 to read as follows: S 86. WINE BOTTLE LABELS; ANTIOXIDANTS. A WINERY MAY INCLUDE ON THE LABEL OF A WINE BOTTLE, A STATEMENT STATING THAT THE WINE CONTAINS ANTI- OXIDANTS, PROVIDED THAT THE WINE BOTTLE BEARING SUCH LABEL IS NOT SOLD, OFFERED FOR SALE, SHIPPED, DELIVERED FOR SHIPMENT OR OTHERWISE INTRO- DUCED INTO COMMERCE OUTSIDE OF THE STATE OF NEW YORK.
