BILL NUMBER: S1615 TITLE OF BILL : An act to amend the legislative law, in relation to requiring the legislature to convene daily after the first of April PURPOSE : To require members of the legislature to meet daily after April 1, until the state budget is passed. SUMMARY OF PROVISIONS : Adds a new Article 2-B to the Legislative Law. Section 39-a (1) defines "meet." Section 39-a (2) requires daily convening of the Legislature, excluding Saturdays, Sundays and holidays until the annual budget is passed. Section 39-a (3) prescribes that the rules of the senate and assembly shall govern the notice of meetings. EXISTING LAW : None. JUSTIFICATION :

VALESKY -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the legislative law, in relation to requiring the legis- lature to convene daily after the first of April THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The legislative law is amended by adding a new article 2-B to read as follows: ARTICLE 2-B MEETINGS OF THE LEGISLATURE SECTION 39-A. MEETINGS OF THE LEGISLATURE. S 39-A. MEETINGS OF THE LEGISLATURE. 1. FOR PURPOSES OF THIS ARTICLE, "MEET" MEANS THE OFFICIAL CONVENING OF A SESSION OF THE LEGISLATURE, EITHER IN REGULAR SESSION OR IN EXTRAORDINARY SESSION, FOR THE PURPOSE OF CONDUCTING THE BUSINESS OF THE LEGISLATURE. 2. IF THE LEGISLATURE HAS FAILED TO PASS THE BILLS CONSTITUTING THE STATE BUDGET SUBMITTED ANNUALLY BY THE GOVERNOR TO THE LEGISLATURE, PURSUANT TO ARTICLE SEVEN OF THE CONSTITUTION MAKING APPROPRIATIONS AND REAPPROPRIATIONS FOR THE SUPPORT OF THE GOVERNMENT, PRIOR TO THE FIRST OF APRIL IN ANY YEAR, THE LEGISLATURE SHALL MEET DAILY, EXCLUDING SATUR- DAYS, SUNDAYS AND HOLIDAYS, UNTIL SUCH BUDGET IS PASSED. 3. THE RULES OF THE SENATE AND THE RULES OF THE ASSEMBLY GOVERNING NOTICE OF MEETINGS WILL BE USED TO CONDUCT A MEETING OF THE LEGISLATURE CALLED PURSUANT TO THIS ARTICLE. S 2. This act shall take effect on the first of April next succeeding the date on which it shall have become a law.
