BILL NUMBER: S1680 TITLE OF BILL : An act to amend the executive law, in relation to establishing the stun gun grant program PURPOSE : To establish a stun gun grant program in the Division of Criminal Justice Services. SUMMARY OF SPECIFIC PROVISIONS : The bill amends the Executive Law by adding a new § 844 thereto which establishes a stun gun grant program within the Division of Criminal Justice Services. Under the bill police departments may apply for funds to either (1) purchase stun guns or (2) reimburse said police departments for funds, other than state funds, previously expended in purchasing stun guns. The bill directs the Office of General Services to contract with a manufacturer of stun guns to obtain the best price available. Additionally, the Division of Criminal Justice Services may require that applicants provide matching funds, but no more than the amount of the grant awarded. Police Departments with annual operating budgets of $150,000 or less shall not be required to come up with matching funds.

FLANAGAN, MORAHAN, WINNER -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law, in relation to establishing the stun gun grant program THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The executive law is amended by adding a new section 844 to read as follows: S 844. STUN GUN GRANT PROGRAM. 1. THERE IS HEREBY ESTABLISHED IN THE DEPARTMENT OF CRIMINAL JUSTICE SERVICES A STUN GUN GRANT PROGRAM, UNDER WHICH GRANTS SHALL BE MADE AVAILABLE TO POLICE DEPARTMENTS FOR THE PURCHASE OF STUN GUNS OR FOR REIMBURSEMENT TO SUCH POLICE DEPARTMENTS FOR PUBLIC FUNDS, OTHER THAN STATE FUNDS, THAT HAVE BEEN EXPENDED FOR THE PURCHASE OF STUN GUNS. SUCH GRANTS SHALL BE MADE AVAILABLE UPON APPLICATION BY SUCH GOVERNING POLICE DEPARTMENTS. THE OFFICE OF GENERAL SERVICES SHALL CONTRACT WITH A MANUFACTURER FOR THE BEST PRICE AVAIL- ABLE. THE DEPARTMENT OF CRIMINAL JUSTICE SERVICES MAY REQUIRE, PURSUANT TO SUCH UNIFORM STANDARDS AS SUCH OFFICE MAY PRESCRIBE, THAT APPLICANTS FOR SUCH GRANTS PROVIDE MATCHING FUNDS OF UP TO, BUT NOT MORE THAN, THE AMOUNT OF THE GRANT AWARDED; PROVIDED, HOWEVER, THAT A POLICE DEPARTMENT HAVING AN ANNUAL OPERATING BUDGET OF ONE HUNDRED FIFTY THOUSAND DOLLARS OR LESS SHALL NOT BE REQUIRED TO PROVIDE MATCHING FUNDS. 2. AS USED IN THIS SECTION, "POLICE DEPARTMENT" MEANS A COUNTY, CITY, VILLAGE OR TOWN POLICE DEPARTMENT OR SHERIFF'S DEPARTMENT. S 2.
