BILL NUMBER: S1744 TITLE OF BILL : An act to amend the public health law, in relation to patient records PURPOSE OR GENERAL IDEA OF BILL : To assure that medical records will be maintained for a reasonable length of time. SUMMARY OF SPECIFIC PROVISIONS : The public health law is amended by adding a new section 2807-o which requires hospitals to maintain patient records be kept in paper, microfilm or electronic form for 25 years. The definition of hospital is extended for the purposes of this section to health maintenance organizations which provide health care to government employees. JUSTIFICATION : The maintenance of records is essential to proper health care. Although most hospitals maintain records while a patient is receiving care and for a few years thereafter, a longer period of retention should be required if illnesses recur. PRIOR LEGISLATIVE HISTORY : This bill has been previously introduced.
