BILL NUMBER: S180 TITLE OF BILL : An act to amend the criminal procedure law, in relation to designating certain employees of the department of motor vehicles as police officers PURPOSE : This bill will provide certain investigators employed by the Department of Motor Vehicles, who are currently classified peace officers, with several additional powers which are only available to government officials classified as police officers. SUMMARY OF PROVISIONS : The bill amends the Criminal Procedure Law in order to add certain investigators of the Department of Motor Vehicles to the list of public officials classified as police officers for certain specified purposes. EXISTING LAW : These officials are currently classified as peace officers pursuant to the provisions of Section 2.10 (32) of the Criminal Procedure Law. JUSTIFICATION : Investigators of the Department of Motor Vehicles are designated as Peace Officers by law. They have authority to make arrests, seize

VOLKER -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the criminal procedure law, in relation to designating certain employees of the department of motor vehicles as police offi- cers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 34 of section 1.20 of the criminal procedure law is amended by adding a new paragraph (w) to read as follows: (W) AN EMPLOYEE OF THE DEPARTMENT OF MOTOR VEHICLES (I) ASSIGNED AS A MOTOR VEHICLE INVESTIGATOR PURSUANT TO SECTION THREE HUNDRED NINETY-TWO-B OF THE VEHICLE AND TRAFFIC LAW, AND (II) ASSIGNED TO THE INVESTIGATION AND ENFORCEMENT OF THE VEHICLE AND TRAFFIC LAW, FOR THE PURPOSES OF APPLYING FOR AND EXECUTING SEARCH WARRANTS UNDER ARTICLE SIX HUNDRED NINETY OF THIS CHAPTER, AND FOR THE PURPOSE OF ACTING AS CLAIM- ING AGENTS UNDER ARTICLE THIRTEEN-A OF THE CIVIL PRACTICE LAW AND RULES IN CONNECTION WITH THE ENFORCEMENT OF THE LAWS REFERRED TO IN THIS PARA- GRAPH.
