BILL NUMBER: S1827 TITLE OF BILL : An act to amend the general business law, in relation to mail-order or telephone-order of movies PURPOSE OR GENERAL IDEA OF BILL : Prohibits penalties to be imposed on heavy users or mail-order movie rental. SUMMARY OF SPECIFIC PROVISIONS : Section one: Amends subdivision 3 of section 396-m of the general business law by adding a new paragraph k that prohibits the advertisement of unlimited movie rental services to New York customers without disclosure of any applicable penalties for heavy usage of such service. JUSTIFICATION : Mail order movie rental services have changed the way many New Yorkers rent movies, but hidden conditions have made promises of unlimited DVDs unattainable for many subscribers. KLEIN -- read twice and ordered printed, and when printed to be committed to the Committee on Consumer Protection AN ACT to amend the general business law, in relation to mail-order or telephone-order of movies THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 396-m of the general business law is amended by adding a new paragraph k to read as follows: K. ADVERTISE UNLIMITED RENTALS TO NEW YORK STATE CONSUMERS OF MOVIES IF THE CUSTOMER WILL BE PENALIZED FOR HEAVY USAGE OF THE RENTAL SERVICE BY THE IMPOSITION OF INTENTIONAL DISADVANTAGES IN THE ALLOCATIONS OF THE RENTAL SERVICE BY THE SELLER INCLUDING BUT NOT LIMITED TO LONGER WAIT TIMES, SLOWER PROCESSING OR SHIPPING DELAYS. ANY SUCH CONDITIONS TO BE IMPOSED UPON A CUSTOMER FOR THE USAGE OF AN UNLIMITED MOVIE RENTAL SERVICE MUST BE CLEARLY AND LEGIBLY DISCLOSED ON ANY PROMOTIONAL MATERI- AL DISTRIBUTED IN THIS STATE.
