BILL NUMBER: S1828 TITLE OF BILL : An act to amend the vehicle and traffic law, in relation to parking regulations for disabled persons PURPOSE : Allows person entitled to disabled person license plate to park free at a parking meter if certain conditions are met. SUMMARY OF PROVISIONS : The legislation amends §404-a of the vehicle and traffic law by adding a new subdivision 5-a exempting from parking meter fees those individuals with state-issued disabled license plates who lack sufficient mobility or fine motor control to either reach a parking meter or insert coins into the device. JUSTIFICATION : This legislation would allow a person already entitled to disabled license plates to park for free at parking meters if certain additional conditions are met. KLEIN -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to parking regulations for disabled persons THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 404-a of the vehicle and traffic law is amended by adding a new subdivision 5-a to read as follows: 5-A. METERED PARKING CHARGES. (A) ANY PERSON ENTITLED TO RECEIVE A DISABLED PERSON PLATE UNDER THIS SECTION SHALL BE ENTITLED TO PARKING AT A METER WITHOUT CHARGE IF HE OR SHE MEETS ONE OF THE FOLLOWING CONDI- TIONS: (1) CANNOT INSERT COINS OR TOKENS IN A PARKING METER OR ACCEPT A TICKET FROM A PARKING LOT MACHINE DUE TO A LACK OF FINE MOTOR CONTROL IN BOTH HANDS; (2) CANNOT REACH TO A HEIGHT OF FORTY-TWO INCHES FROM THE GROUND DUE TO A LACK OF FINGER, HAND OR UPPER EXTREMITY STRENGTH OR MOBILITY; (3) CANNOT APPROACH CLOSE ENOUGH TO INSERT COINS INTO A PARK- ING METER DUE TO USE OF A WHEELCHAIR OR OTHER AMBULATORY DEVICE. (B) THE APPLICATION FOR PERMISSION TO PARK FREE OF CHARGE UNDER THIS SUBDIVISION SHALL BE FILED WITH THE COMMISSIONER IN SUCH FORM AND DETAIL AS THE COMMISSIONER SHALL PRESCRIBE. THE FORM OF PERMISSION TO PARK FREE OF CHARGE UNDER THIS SUBDIVISION SHALL BE DETERMINED BY THE COMMISSION- ER. S 2. This act shall take effect on the first of January next succeed- ing the date on which it shall have become a law.
