BILL NUMBER: S1859 TITLE OF BILL : An act to amend the public health law, in relation to establishing an electronic health records and electronic prescribing initiative; and providing for the repeal of such provisions upon expiration thereof PURPOSE : Establishes an electronic health records and electronic prescribing initiative. SUMMARY OF PROVISIONS : Adds a new article 10 to the public health law directing the office of health information technology to establish an electronic health records and electronic prescribing initiative program to provide incentives for office-based physicians and small, independent pharmacies to adopt computerized records and prescribing pursuant to standards and criteria established by the office. The program shall be allocated $5,000,000 in its first year and be subject to budget appropriation in years 2-4. The program will sunset four years after its enactment. JUSTIFICATION : Recent studies have estimated that 2-3 million errors occur each year at retail pharmacies around the U.S., including approximately 210,000

KLEIN -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to establishing an electronic health records and electronic prescribing initiative; and providing for the repeal of such provisions upon expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new article 10 to read as follows: ARTICLE 10 ELECTRONIC HEALTH RECORDS AND ELECTRONIC PRESCRIBING SECTION 1000. ELECTRONIC HEALTH RECORDS AND ELECTRONIC PRESCRIBING INITIATIVE PROGRAM. S 1000. ELECTRONIC HEALTH RECORDS AND ELECTRONIC PRESCRIBING INITI- ATIVE PROGRAM. 1. DEFINITIONS. AS USED IN THIS SECTION, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS: (A) ELECTRONIC HEALTH RECORDS (EHR) IS A LONGITUDINAL ELECTRONIC RECORD OF PATIENT HEALTH INFORMATION GENERATED BY ONE OR MORE ENCOUNTERS IN ANY CARE DELIVERY SETTING. (B) ELECTRONIC PRESCRIBING (E-PRESCRIBING) IS A COMPUTER BASED METHOD TO GENERATE PRESCRIPTIONS THROUGH AN AUTOMATED DATA ENTRY PROCESS UTILIZING E-PRESCRIBING SOFTWARE AND A TRANSMISSION NETWORK WHICH LINKS TO PARTICIPATING PHARMACIES. 2. CREATION OF PROGRAM. THE OFFICE OF HEALTH INFORMATION TECHNOLOGY TRANSFORMATION IS HEREBY AUTHORIZED TO ESTABLISH AND ADMINISTER AN ELEC- TRONIC HEALTH RECORDS AND PRESCRIBING PROGRAM TO PROVIDE INCENTIVES FOR THE USE OF ELECTRONIC TECHNOLOGIES BY OFFICE-BASED PHYSICIANS AND INDE- PENDENT PHARMACIES, PURSUANT TO STANDARDS AND CRITERIA ESTABLISHED BY THE OFFICE.
