AN ACT to amend the public health law, in relation  to  establishing  an
  electronic  health  records and electronic prescribing initiative; and
  providing for the repeal of such provisions upon expiration thereof

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The public health law is amended by adding a new article 10
to read as follows:

                               ARTICLE 10
          ELECTRONIC HEALTH RECORDS AND ELECTRONIC PRESCRIBING

SECTION  1000.  ELECTRONIC  HEALTH  RECORDS  AND  ELECTRONIC PRESCRIBING
                  INITIATIVE PROGRAM.
  S 1000. ELECTRONIC HEALTH RECORDS AND  ELECTRONIC  PRESCRIBING  INITI-
ATIVE  PROGRAM.  1.  DEFINITIONS. AS USED IN THIS SECTION, THE FOLLOWING
TERMS SHALL HAVE THE FOLLOWING MEANINGS: (A) ELECTRONIC  HEALTH  RECORDS
(EHR)  IS A LONGITUDINAL ELECTRONIC RECORD OF PATIENT HEALTH INFORMATION
GENERATED BY ONE OR MORE ENCOUNTERS IN ANY CARE DELIVERY SETTING.
  (B) ELECTRONIC PRESCRIBING (E-PRESCRIBING) IS A COMPUTER BASED  METHOD
TO  GENERATE  PRESCRIPTIONS  THROUGH  AN  AUTOMATED  DATA  ENTRY PROCESS
UTILIZING E-PRESCRIBING SOFTWARE AND A TRANSMISSION NETWORK WHICH  LINKS
TO PARTICIPATING PHARMACIES.
  2.  CREATION  OF  PROGRAM. THE OFFICE OF HEALTH INFORMATION TECHNOLOGY
TRANSFORMATION IS HEREBY AUTHORIZED TO ESTABLISH AND ADMINISTER AN ELEC-
TRONIC HEALTH RECORDS AND PRESCRIBING PROGRAM TO PROVIDE INCENTIVES  FOR
THE  USE OF ELECTRONIC TECHNOLOGIES BY OFFICE-BASED PHYSICIANS AND INDE-
PENDENT PHARMACIES, PURSUANT TO STANDARDS AND  CRITERIA  ESTABLISHED  BY
THE  OFFICE.  SUCH GRANT PROGRAM SHALL BE ALLOCATED FIVE MILLION DOLLARS
