BILL NUMBER: S1879 TITLE OF BILL : An act to amend the public health law, in relation to furnishing costs of drugs to consumers PURPOSE : Makes cost of drugs available to consumer from health department by telephone SUMMARY OF PROVISIONS : Amends section 3333 of the public health law by adding a new subdivision 6 requiring pharmacies to provide their prescription drug retail price list to the commissioner of health at least once a week, for inclusion in a statewide drug price database that the department will make available via a toll-free telephone number. JUSTIFICATION : This bill will provide consumers with an easy and affordable means of comparing prices on their prescription medications.

KLEIN -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to furnishing costs of drugs to consumers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3333 of the public health law is amended by adding a new subdivision 6 to read as follows: 6. EVERY PHARMACY OPERATED BY A LICENSED PHARMACIST SHALL FURNISH TO THE COMMISSIONER AT A TIME AND PLACE TO BE DETERMINED BY THE COMMISSION- ER, BUT IN NO EVENT LESS THAN ONCE A WEEK, A LIST OF PRESCRIPTION DRUGS AS DEFINED IN SECTION SIXTY-EIGHT HUNDRED TWO OF THE EDUCATION LAW TOGETHER WITH THEIR CURRENT SELLING PRICE. THE COMMISSIONER SHALL ESTAB- LISH A TOLL-FREE TELEPHONE NUMBER AND A WEBSITE WHERE THE CONTENTS OF SUCH LIST SHALL BE AVAILABLE TO THE PUBLIC. S 2. This act shall take effect immediately.
