BILL NUMBER: S1947 TITLE OF BILL : An act to amend the labor law, in relation to asbestos notification fees PURPOSE : Requires that contractors who are employed by the City of Buffalo to demolish a building containing asbestos be exempt from paying an asbestos notification fee. SUMMARY OF PROVISIONS : Section 1 amends section 904 of the Labor Law by adding a new subdivision 5 which exempts any contractor employed by the City of Buffalo for the demolition of a building that contains asbestos, including independent contractors, from paying the asbestos notification fee established under subdivision two of this section. JUSTIFICATION : Under section 904 of the Labor Law, notification must be given to the State of New York of demolition activity due to air monitoring, worker

STACHOWSKI -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT to amend the labor law, in relation to asbestos notification fees THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 904 of the labor law is amended by adding a new subdivision 5 to read as follows: 5. ANY CONTRACTOR WHO IS EMPLOYED BY THE CITY OF BUFFALO FOR THE DEMO- LITION OF A BUILDING THAT CONTAINS ASBESTOS, INCLUDING INDEPENDENT CONTRACTORS, SHALL NOT BE REQUIRED TO PAY THE ASBESTOS NOTIFICATION FEE ESTABLISHED PURSUANT TO SUBDIVISION TWO OF THIS SECTION.
