2009-S1957 (ACTIVE) - Summary

Provides for the implementation of a STOP DWI memorial signage program to include the names of drunk driving victims on a sign placed along the highways of this state; provides for the placement of memorial signage bearing the warning "Don't Drink and Drive" along with the names of victims of a drunk driving accident; provides no signs shall be placed on an interstate highway; provides such signage shall require a one hundred dollar fee by a family member or other sponsor and such sign shall remain in duration for two years.

AN ACT to amend the vehicle and traffic law, in  relation  to  providing
  for a "STOP DWI" memorial signing program

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The vehicle and traffic law is  amended  by  adding  a  new
section 1199-a to read as follows:
  S  1199-A.  "STOP  DWI" MEMORIAL SIGNING PROGRAM. 1. PURSUANT TO RULES
AND REGULATIONS DULY ADOPTED, THE COMMISSIONER SHALL DESIGN  AND  IMPLE-
MENT A "STOP DWI" MEMORIAL SIGNING PROGRAM.
  2.  SUCH  PROGRAM SHALL PROVIDE FOR THE PLACEMENT OF APPROPRIATE SIGNS
BEARING THE ADMONITION "DON'T DRINK AND DRIVE" FOLLOWED BY THE NAME OF A
PERSON WHO WAS KILLED IN A MOTOR VEHICLE ACCIDENT  BY  A  PERSON  SUBSE-
QUENTLY CONVICTED OF AN ALCOHOL OR DRUG RELATED TRAFFIC OFFENSE.
  3. NO SIGNS SHALL BE INSTALLED ON AN INTERSTATE HIGHWAY. A SIGN MAY BE
INSTALLED  ON  A  NON-INTERSTATE  HIGHWAY WITHIN A CITY OR TOWN WITH THE
CONCURRENCE OF THE LOCAL GOVERNMENT. A SIGN MAY BE INSTALLED ON A  RURAL
NON-INTERSTATE HIGHWAY.
  4. A SIGN MUST BE REQUESTED BY THE FAMILY OF THE VICTIM OR OTHER SPON-
SOR WITH THE CONCURRENCE OF THE VICTIM'S FAMILY. WHEN THERE ARE MULTIPLE
FATALITIES,  A SIGN CANNOT BE ERECTED FOR A FATAL DRIVER WHO IS SHOWN BY
TOXICOLOGY REPORTS TO BE IN VIOLATION OF  AN  ALCOHOL  OR  DRUG  RELATED
TRAFFIC  OFFENSE,  WITHOUT  CONCURRENCE  OF  ALL  FAMILY  MEMBERS OF THE
VICTIMS KILLED IN THE MOTOR VEHICLE ACCIDENT.
  5. THE DEPARTMENT, UPON PAYMENT OF A ONE HUNDRED DOLLAR FEE BY A FAMI-
LY MEMBER OR OTHER SPONSOR OF A VICTIM, SHALL INSTALL SUCH SIGN  AND  IT
SHALL REMAIN IN PLACE FOR A PERIOD OF TWO YEARS.
  S 2. This act shall take effect immediately.
