BILL NUMBER: S197 TITLE OF BILL : An act to amend the correction law, in relation to denying violent felony offenders a license to possess a firearm SUMMARY : This bill amends section 701 of correction law so that a certificate of relief from disabilities prohibits a person convicted of a violent felony offense from obtaining a license to carry, possess, repair or dispose of a firearm. JUSTIFICATION : In the past, a certificate of relief from disabilities enabled a person who had been convicted of a violent felony offense to obtain a firearm. Unfortunately, this ignores the fact that many of our state's felony offenders are repeat felony offenders. It is inconceivable to provide a felony offender with the very weapon which may convict him/her of a future felony. FISCAL IMPLICATION : To be determined.

KRUGER -- read twice and ordered printed, and when printed to be committed to the Committee on Crime Victims, Crime and Correction AN ACT to amend the correction law, in relation to denying violent felo- ny offenders a license to possess a firearm THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 701 of the correction law is amended by adding a new subdivision 4 to read as follows: 4. A CERTIFICATE OF RELIEF FROM DISABILITIES SHALL NOT ENABLE A PERSON WHO HAS BEEN CONVICTED OF A VIOLENT FELONY OFFENSE, AS DEFINED IN SUBDI- VISION ONE OF SECTION 70.02 OF THE PENAL LAW, TO OBTAIN A LICENSE TO CARRY, POSSESS, REPAIR OR DISPOSE OF A FIREARM. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD03116-01-9
