BILL NUMBER: S2000 TITLE OF BILL : An act to amend the general municipal law, in relation to school district approval of subdivisions PURPOSE : This bill authorizes a municipality to require the owner of a parcel applying for a subdivision to receive written confirmation from a school district that such parcel is located within the school district's boundaries. SUMMARY OF PROVISIONS : This bill amends the General Municipal Law to authorize a municipality to empower, by local resolution, the planning board to require the owner of a parcel applying for subdivision receive notification from a school district that such parcel is located within the school district's boundaries. JUSTIFICATION : This bill, in requiring confirmation from the school district that the land to be subdivided is actually within the school district's boundaries accomplishes a number of goals. First, this bill informs the respective district that there is new subdivided property within their district. Such confirmation becomes imperative where large parcels are subdivided and span two school districts or town fire

LAVALLE -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the general municipal law, in relation to school district approval of subdivisions THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general municipal law is amended by adding a new section 99-v to read as follows: S 99-V. SCHOOL DISTRICT APPROVAL OF SUBDIVISION. A GOVERNING BOARD MAY, BY RESOLUTION, AUTHORIZE AND EMPOWER THE PLANNING BOARD TO REQUIRE THE OWNER OF A PARCEL PROPOSED FOR SUBDIVISION TO APPLY FOR AND RECEIVE NOTIFICATION FROM A SCHOOL DISTRICT AS TO WHETHER SUCH PARCEL IS LOCATED WITHIN THE SCHOOL DISTRICT'S BOUNDARIES. S 2. This act shall take effect on the ninetieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
