BILL NUMBER: S2001 TITLE OF BILL : An act to amend the banking law, in relation to prohibiting the charging of certain ATM fees for accessing child support payments PURPOSE : The Child Support Collections unit has determined it to be more cost effective to issue payments in the form of a direct deposit to a debit card rather than issuing and mailing paper checks. This legislation would prohibit banks from charging fees to those persons who are accessing child support payments through the ATM. SUMMARY OF PROVISIONS : The banking law is amended by adding a new section 9-v which requires banks to waive ATM fees for any person accessing child support payments. Requires the Superintendent of the New York State Banking Department to work with the Commissioner of Children and Family Services to promulgate rules and regulations necessary for the implementation of this section. JUSTIFICATION : Many single parents rely heavily on child support payments to make ends meet for their families. The current system charges ATM fees for

THIELE -- read once and referred to the Committee on Banks AN ACT to amend the banking law, in relation to prohibiting the charging of certain ATM fees for accessing child support payments THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The banking law is amended by adding a new section 9-v to read as follows: S 9-V. ATM TRANSACTIONS BY PERSONS ACCESSING CHILD SUPPORT PAYMENTS. 1. ANY BANK, AS DEFINED IN SUBDIVISION ONE OF SECTION TWO OF THIS ARTI- CLE, SHALL WAIVE THE ATM FEE OF ANY PERSON ACCESSING CHILD SUPPORT PAYMENTS PURSUANT TO ANY ORDER OF CHILD SUPPORT OR CHILD AND SPOUSAL SUPPORT ISSUED UNDER THE PROVISIONS OF SECTION TWO HUNDRED THIRTY-SIX OR TWO HUNDRED FORTY OF THE DOMESTIC RELATIONS LAW, OR ARTICLE FOUR, FIVE, FIVE-A OR FIVE-B OF THE FAMILY COURT ACT. 2. THE SUPERINTENDENT, IN CONJUNCTION WITH THE COMMISSIONER OF THE OFFICE OF CHILDREN AND FAMILY SERVICES, SHALL PROMULGATE ANY RULES AND REGULATIONS NECESSARY FOR THE IMPLEMENTATION OF THIS SECTION. S 2. This act shall take effect on the one hundred twentieth day after it shall have become a law; provided, however, that effective immediate- ly, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date are authorized and directed to be made and completed on or before such effective date.
