BILL NUMBER: S2036 TITLE OF BILL : An act to amend the environmental conservation law, in relation to the New York state canal flood mitigation task force PURPOSE : Enacts a chapter amendment to chapter 336 of the laws of 2008 to clarify the provisions of the law regarding the appointment of members to the Citizen Advisory Board. SUMMARY OF PROVISIONS : Section 1 amends subdivision 6 of section 73-0105 of the environmental conservation law to clarify the method of appointment of members to the Citizen Advisory Board to the New York State Canal Flood Mitigation Task Force. Section 2 establishes an effective date. JUSTIFICATION : This is a chapter amendment to chapter 336 of the laws of 2008. The

DeFRANCISCO -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conser- vation AN ACT to amend the environmental conservation law, in relation to the New York state canal flood mitigation task force THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 6 of section 73-0105 of the environmental conservation law, as added by chapter 336 of the laws of 2008, is amended to read as follows: 6. To help ensure the task force's receipt of a comprehensive and diverse array of views, a citizen advisory board to the task force shall be established. The advisory board shall consist of up to thirteen members appointed BY THE GOVERNOR for two years, [seven members shall be appointed following the recommendation of the governor;] INCLUDING two members [shall be appointed following] ON the recommendation of the temporary president of the senate; two members [shall be appointed following] ON the recommendation of the speaker of the assembly; one member [shall be appointed following] ON the recommendation of the minority leader of the senate; and one member [shall be appointed following] ON the recommendation of the minority leader of the assembly. The advisory board shall represent a diverse array of interests, includ- ing property owners residing adjacent to or in close proximity to the canal system or major water bodies within the Oswego river basin, recre- ational and commercial users of the canal system, environmental groups and hydroelectric power generators that operate facilities within the canal system. No member of the advisory board may be concurrently employed by, or provide goods or services to, any agency or public corporation which is represented on the task force. The commissioner shall select a member of the advisory board to serve as chairperson. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
