BILL NUMBER: S2045 TITLE OF BILL : An act to amend the education law, in relation to prohibiting discrimination on account of a person's military status in the United States armed forces PURPOSE : To ensure that a student's military status is not used to disadvantage or disqualify him or her from participation in high school extracurricular activities, including, but not limited to, high school athletics. SUMMARY OF PROVISIONS : Section 1 -- Adds a section 3201-b to the Education Law. This new section prohibits a student's military status from being used to exclude, disadvantage, or disqualify the student from high school or extracurricular activities, including, but not limited to, high school athletics. Section 2 -- Effective date.

DeFRANCISCO, GOLDEN, LANZA, LAVALLE, MAZIARZ, MORA- HAN, SEWARD, VOLKER -- read twice and ordered printed, and when print- ed to be committed to the Committee on Education AN ACT to amend the education law, in relation to prohibiting discrimi- nation on account of a person's military status in the United States armed forces THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 3201-b to read as follows: S 3201-B. DISCRIMINATION ON ACCOUNT OF MILITARY STATUS. NOTWITHSTAND- ING ANY GENERAL, SPECIAL, LOCAL LAW OR RULE OR REGULATION OF THE DEPART- MENT TO THE CONTRARY, NO PERSON SHALL BE EXCLUDED, DISQUALIFIED OR DISADVANTAGED IN ANY WAY FROM PARTICIPATION IN ANY HIGH SCHOOL OR EXTRA- CURRICULAR ACTIVITIES, INCLUDING BUT NOT LIMITED TO PARTICIPATION IN STATE PUBLIC AND HIGH SCHOOL ATHLETIC TEAMS, BY REASON OF THAT PERSON'S STATUS IN THE UNITED STATES ARMED FORCES, EXCEPT PURSUANT TO REGULATIONS PROMULGATED BY THE COMMISSIONER.
