BILL NUMBER: S2078 TITLE OF BILL : An act to amend the insurance law, in relation to requiring insurance companies to disapprove defensive driving courses instructed solely over the internet without an instructor physically present PURPOSE OR GENERAL IDEA OF BILL : This bill prohibits insurances from providing credit for accident prevention course taken over the internet. SUMMARY OF SPECIFIC PROVISIONS : Section 1 - the insurance law is amended by adding a new section 2335-b that reads in part: "no insurer authorized to transact business in this state... reduce a policy holder's premium rate for the completion of a defensive driving course or defensive driving program instructed solely over the internet and without a certified instructor physically present. JUSTIFICATION : This legislation would prohibit individuals from getting credit for defensive driving courses taken over the internet. Insurance companies would not be able to provide credit and discounts for completion of this course, if such course or program is taken over the internet.

PARKER -- read twice and ordered printed, and when printed to be committed to the Committee on Insurance AN ACT to amend the insurance law, in relation to requiring insurance companies to disapprove defensive driving courses instructed solely over the internet without an instructor physically present THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The insurance law is amended by adding a new section 2335-b to read as follows: S 2335-B. MOTOR VEHICLE INSURANCE RATES; PROHIBITED REDUCTION FOR INTERNET DRIVING COURSES OR PROGRAMS. NO INSURER AUTHORIZED TO TRANSACT OR TRANSACTING BUSINESS IN THIS STATE, OR CONTROLLING OR CONTROLLED BY OR UNDER COMMON CONTROL BY OR WITH AN INSURER AUTHORIZED TO TRANSACT OR TRANSACTING BUSINESS IN THIS STATE, WHICH SELLS A POLICY PROVIDING MOTOR VEHICLE LIABILITY OR MOTORCYCLE INSURANCE COVERAGE IN THIS STATE SHALL REDUCE A POLICY HOLDER'S PREMIUM RATE FOR THE COMPLETION OF A MOTOR VEHICLE ACCIDENT PREVENTION COURSE INSTRUCTED SOLELY OVER THE INTERNET AND WITHOUT A CERTIFIED INSTRUCTOR PHYSICALLY PRESENT FOR SUCH INSTRUC- TION OR OF ANY OTHER SUCH COURSE OR TRAINING PROGRAM CONDUCTED BY AND THROUGH SUCH TECHNOLOGICAL MEANS. S 2. This act shall take effect on the ninetieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
