BILL NUMBER: S2155 TITLE OF BILL : An act to amend the environmental conservation law, in relation to special permits and certification for commercial application of aquatic antifouling paints PURPOSE : States that social security numbers shall not appear on certain public records filed with a public entity in order to help combat identity theft. SUMMARY OF PROVISIONS : Adds a new section 50-f to the civil rights law to state that no public entity or any officer or employee thereof shall require a person's social security number to appear on mortgages, judgments, uniform commercial code filings, death certificates, veteran's discharges, or state tax warrants. However, at its discretion they may enter into an agreement to provide a persons social security number when necessary to further the entity's official functions. Subdivision 2 states that a public entity in receipt of a request for a record which contains a person's social security number shall reject the request if they determine that record sought could be used for any commercial, illegal or unrelated purposes. Subdivision 3 states the definition of public entity.

JOHNSON, LANZA, LIBOUS, MORAHAN, RANZENHOFER, SALAND, SKELOS, VOLKER, YOUNG -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the civil rights law, in relation to establishing social security numbers shall not appear on certain public records THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The civil rights law is amended by adding a new section 50-f to read as follows: S 50-F. PRIVACY OF PUBLIC RECORDS. 1. A. NO PUBLIC ENTITY, NOR ANY OFFICER OR EMPLOYEE THEREOF, SHALL REQUIRE A PERSON'S SOCIAL SECURITY NUMBER TO APPEAR ON THE FOLLOWING PUBLIC RECORDS: (I) MORTGAGES; (II) JUDGMENTS; (III) UNIFORM COMMERCIAL CODE FILINGS; (IV) DEATH CERTIFICATES; (V) VETERAN'S DISCHARGES; OR (VI) STATE TAX WARRANTS. B. THE PROVISIONS OF THIS SUBDIVISION SHALL NOT PROHIBIT A PUBLIC ENTITY, IN ITS DISCRETION, FROM ENTERING INTO AGREEMENTS WITH ANY OTHER PUBLIC ENTITIES FOR THE PROVISION OF A PERSON'S SOCIAL SECURITY NUMBER WHEN NECESSARY TO FURTHER THE PUBLIC ENTITY'S OFFICIAL FUNCTIONS. 2. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, A PUBLIC ENTITY IN RECEIPT OF A REQUEST FOR A RECORD WHICH CONTAINS A PERSON'S SOCIAL SECU- RITY NUMBER SHALL REJECT SUCH A REQUEST IF SUCH ENTITY DETERMINES THAT THE RECORD SOUGHT WOULD, IF DISCLOSED, BE USED FOR ANY COMMERCIAL, ILLE- GAL OR ANY OTHER UNRELATED PURPOSE. 3. FOR PURPOSES OF THIS SECTION, "PUBLIC ENTITY" MEANS ANY STATE OR LOCAL DEPARTMENT, AGENCY, BOARD, BUREAU, DIVISION, COMMISSION, PUBLIC AUTHORITY, PUBLIC BENEFIT CORPORATION, OFFICE, OR ANY OTHER ENTITY EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
