BILL NUMBER: S2381 TITLE OF BILL : An act to amend the racing, pari-mutuel wagering and breeding law, in relation to providing that certain associations or corporations that permit any persons under the age of eighteen to bet on a horse race shall be guilty of a misdemeanor PURPOSE : To make an employee of a licensed association or corporation who permits a person under eighteen years of age to bet on a horse race guilty of a misdemeanor. SUMMARY OF PROVISIONS : The bill would amend section 104 of the racing, pari-mutuel wagering and breeding law, as amended by chapter 919 of the laws of 1986, to provide that no licensed association or corporation shall permit any person who is actually and apparently under eighteen years of age to bet on a horse race, nor shall such person be permitted to bet at an establishment of a regional corporation conducting off-track betting. Specifically, the bill provides that any employee of a licensed association or corporation who permits or offers to permit any person who is actually and apparently under eighteen years of age to bet on a horse race shall be guilty of a misdemeanor. PADAVAN -- read twice and ordered printed, and when printed to be committed to the Committee on Racing, Gaming and Wager- ing AN ACT to amend the racing, pari-mutuel wagering and breeding law, in relation to providing that certain associations or corporations that permit any persons under the age of eighteen to bet on a horse race shall be guilty of a misdemeanor THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 104 of the racing, pari-mutuel wagering and breed- ing law, as amended by chapter 919 of the laws of 1986, is amended to read as follows: S 104. Prohibition of wagering by certain officials, employees and minors. 1. No member, secretary, deputy, officer, representative, employee or counsel of the board shall wager either upon the outcome of any horse race conducted at a track at which pari-mutuel betting is conducted by any licensee or franchisee of the board. 2. No association or corporation which is licensed or franchised by the board shall permit any person who is actually and apparently under eighteen years of age to bet on a horse race conducted by it nor shall such person be permitted to bet at an establishment of a regional corpo- ration conducting off-track betting. ANY EMPLOYEE OF AN ASSOCIATION OR CORPORATION WHICH IS LICENSED OR FRANCHISED BY THE BOARD THAT PERMITS OR OFFERS TO PERMIT ANY PERSON WHO IS ACTUALLY AND APPARENTLY UNDER EIGH- TEEN YEARS OF AGE TO BET ON A HORSE RACE CONDUCTED BY IT SHALL BE GUILTY OF A MISDEMEANOR. 3. No individual employed by an off-track betting corporation as a pari-mutuel clerk, cashier or seller shall be permitted to bet during those periods of any day on which such person is actually employed in such capacity. S 2. This act shall take effect on the first of November next succeed- ing the date on which it shall have become a law.
