BILL NUMBER: S2426 TITLE OF BILL : An act to amend the agriculture and markets law, in relation to downed animals PURPOSE : The subject bill amends Section 96-g of the agriculture and markets law, to add the definition of a "downed animal". Such animal is defined as any live species of cattle that is unable to stand and walk without assistance. It also adds a new Section 96-k to such law, which provides that no slaughterhouse, stockyard, auction market agency or dealer shall receive a downed animal for human consumption. Further, if a slaughterhouse, stockyard, et al finds itself with a downed animal it must take immediate action to see that it is removed from the premises and does not enter the food supply. A violation of this Section shall be a misdemeanor. JUSTIFICATION : This proposal amends the Agriculture and Markets law to provide that a "downed" animal" be humanely euthanized or given veterinary treatment. This will ensure that "downer" animals do not enter the nation's food supply, thereby protecting the public health. LEGISLATIVE HISTORY : S.7847 of 2008
