BILL NUMBER: S2539 TITLE OF BILL : An act to amend the public health law, in relation to patient notification of services provided by non-participating providers at a participating hospital PURPOSE : Requires hospitals to notify patients of a non-participating physician or health care provider providing treatment at a participating hospital. SUMMARY OF PROVISIONS : Section 1 amends the public health law by adding § 2805-s. Section 2 is the effective date. JUSTIFICATION : The difficulties patients encounter when seeking treatment for a serious ailment or disease can be trying. In addition to dealing with the trauma and anxiety of their condition, patients and their families are also troubled with understanding a complex health care system. When choosing a doctor and a treatment path, discovering what your insurance covers and what it does not cover can bring added stress. Many patients try hard to abide by the rules of their insurance

MAZIARZ -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to patient notifica- tion of services provided by non-participating providers at a partic- ipating hospital THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 2805-t to read as follows: S 2805-T. NOTIFICATION OF NON-PARTICIPATING PROVIDERS PROVIDING TREAT- MENT AT A PARTICIPATING HOSPITAL. EVERY HOSPITAL SHALL BE REQUIRED TO NOTIFY A PATIENT ADMITTED TO SUCH HOSPITAL IF A PHYSICIAN OR HEALTH CARE PROVIDER PROVIDING TREATMENT TO SUCH PATIENT IS NOT A PARTICIPATING PROVIDER IN THE NETWORK OF ANY INSURER WHOSE PLANS OR POLICIES OF INSUR- ANCE ARE ACCEPTED BY SUCH HOSPITAL. THE NOTIFICATION REQUIRED BY THIS SECTION SHALL BE PRIOR TO SUCH PHYSICIAN OR HEALTH CARE PROVIDER TREAT- ING THE PATIENT. S 2.
