BILL NUMBER: S2563 TITLE OF BILL : An act to amend the public officers law, in relation to records to be made available to the public PURPOSE : To ensure that citizens of New York State, through the Freedom of Information Law, have access to government e-mail and text messages. SUMMARY OF PROVISIONS : Section 1 -- Amends subdivision 4 of section 86 of the Public Officers Law to include e-mail or text messages in the definition of "record" for purposes of the Freedom of Information Law. Section 2 -- Effective date. EXISTING LAW : Subdivision 4 of section 86 of the Public Officers law does not currently include "e-mail" or "text messages" in the definition of "record" for purposes of the Freedom of Information Law.

DeFRANCISCO -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Government Operations AN ACT to amend the public officers law, in relation to records to be made available to the public THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 4 of section 86 of the public officers law, as added by chapter 933 of the laws of 1977, is amended to read as follows: 4. "Record" means any information kept, held, filed, produced or reproduced by, with or for an agency or the state legislature, in any physical form whatsoever including, but not limited to, reports, state- ments, examinations, memoranda, opinions, folders, files, books, manu- als, pamphlets, forms, papers, designs, drawings, maps, photos, letters, microfilms, computer tapes or discs, E-MAIL OR TEXT MESSAGES, rules, regulations or codes. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD09659-01-9
