BILL NUMBER: S2583 TITLE OF BILL : An act to amend the vehicle and traffic law and the education law, in relation to electronic monitoring equipment on school buses in the city of New York SUMMARY OF PROVISIONS : Section 1 amends section 375 of the vehicle and traffic law by inserting a new subdivision 21(j) to require that every new school bus purchased for transportation of seven or more passengers in New York City on or after September first, two thousand eleven, be equipped with a school bus electronic monitoring system, by which is meant one or more electronic devices capable of recording the speed, sound, conduct and movement of persons within the driver and passenger compartments of the bus. Such system may also include one or more devices designed to simulate the appearance of an operable video camera or other device. Every existing bus would have to meet the requirements by 2014. Section 2 amends the education law by adding new section 3624, to require the Education Commissioner in consultation with the commissioner of DOT and DMV to promulgate regulations concerning the

GOLDEN, MAZIARZ, PADAVAN -- read twice and ordered printed, and when printed to be committed to the Committee on Trans- portation AN ACT to amend the vehicle and traffic law and the education law, in relation to electronic monitoring equipment on school buses in the city of New York THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 375 of the vehicle and traffic law is amended by adding a new subdivision 21-j to read as follows: 21-J. EVERY NEW SCHOOL BUS USED TO TRANSPORT SEVEN OR MORE CHILDREN IN A CITY WITH A POPULATION OF ONE MILLION OR MORE SHALL BE EQUIPPED WITH A SCHOOL BUS ELECTRONIC MONITORING SYSTEM ON AND AFTER SEPTEMBER FIRST, TWO THOUSAND TWELVE, AND EVERY SCHOOL BUS IN SERVICE FOR SUCH TRANSPORT SHALL BE SO EQUIPPED NOT LATER THAN SEPTEMBER FIRST, TWO THOUSAND FIFTEEN, PURSUANT TO RULES AND REGULATIONS PROMULGATED BY THE COMMIS- SIONER AFTER CONSULTATION WITH THE COMMISSIONERS OF TRANSPORTATION AND EDUCATION. FOR THE PURPOSES OF THIS SUBDIVISION, THE TERM "SCHOOL BUS ELECTRONIC MONITORING SYSTEM" MEANS ONE OR MORE ELECTRONIC DEVICES CAPA- BLE OF RECORDING THE SPEED, SOUND, CONDUCT AND MOVEMENT OF PERSONS WITH- IN THE DRIVER AND PASSENGER COMPARTMENTS OF THE BUS. SUCH SYSTEM MAY ALSO INCLUDE ONE OR MORE DEVICES DESIGNED TO SIMULATE THE APPEARANCE OF AN OPERABLE VIDEO CAMERA OR OTHER DEVICE. S 2. The education law is amended by adding a new section 3624-a to read as follows: S 3624-A. SCHOOL BUS ELECTRONIC MONITORING SYSTEMS. THE COMMISSIONER, IN CONSULTATION WITH THE COMMISSIONER OF TRANSPORTATION AND THE COMMIS- SIONER OF MOTOR VEHICLES, SHALL PROMULGATE REGULATIONS CONCERNING THE EQUIPPING, PLACEMENT, INSTALLATION, AND USE OF SCHOOL BUS ELECTRONIC MONITORING SYSTEMS IN SCHOOL BUSES AS REQUIRED PURSUANT TO SUBDIVISION TWENTY-ONE-J OF SECTION THREE HUNDRED SEVENTY-FIVE OF THE VEHICLE AND EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
