BILL NUMBER: S2657 TITLE OF BILL : An act to amend the criminal procedure law, in relation to granting certain federal law enforcement officers the power to act as peace officers; and to repeal subdivision 6 of section 2.15 of such law relating to Federal Protective Officers PURPOSE : To amend Section 2.15 of the Criminal Procedure Law to reflect a change in title of certain federal law enforcement officers which resulted from the restructuring of several federal agencies under the Homeland Security Act of 2002 enacted by Congress. SUMMARY OF PROVISIONS : Section 1 amends Subdivisions 3 and 7 of Section 2.15 of the Criminal Procedure Law to reflect the change in title of certain federal law enforcement officers formerly employed in the U.S. Customs Service, Immigration and Naturalization Service and General Services Administration. VOLKER -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the criminal procedure law, in relation to granting certain federal law enforcement officers the power to act as peace officers; and to repeal subdivision 6 of section 2.15 of such law relating to Federal Protective Officers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivisions 3 and 7 of section 2.15 of the criminal proce- dure law, subdivision 3 as amended by chapter 522 of the laws of 1995 and subdivision 7 as amended by chapter 68 of the laws of 1983, are amended to read as follows: 3. UNITED STATES Immigration and [Naturalization Service immigration inspectors, special agents, patrol officers and] CUSTOMS ENFORCEMENT SPECIAL AGENTS, deportation officers, IMMIGRATION ENFORCEMENT AGENTS, FEDERAL PROTECTIVE SERVICE OFFICERS AND AGENTS, AND ANY OTHER EMPLOYEE OF SUCH AGENCY AUTHORIZED TO MAKE ARRESTS UNDER FEDERAL LAW. 7. United States Customs [Service special agents, inspectors and patrol] AND BORDER PROTECTION officers, BORDER PATROL AGENTS, AIR AND MARINE INTERDICTION AGENTS, AVIATION ENFORCEMENT AGENTS, INTERNAL AFFAIRS SPECIAL AGENTS, AND ANY OTHER EMPLOYEE OF SUCH AGENCY AUTHORIZED TO MAKE ARRESTS UNDER FEDERAL LAW. S 2. Subdivision 6 of section 2.15 of the criminal procedure law is REPEALED. S 3. This act shall take effect immediately.
