2009-S2722 (ACTIVE) - Summary
Authorizes an appeal by the people, as of right, to an intermediate appellate court from an order of a criminal court, entered before trial, pursuant to section 710.30 of the criminal procedure law, suppressing the introduction of evidence; requires in such an appeal that the people file a statement in the appellate court as is currently required for an appeal from an order suppressing evidence.

BILL NUMBER: S2722 TITLE OF BILL : An act to amend the criminal procedure law, in relation to appeals from certain orders of suppression PURPOSE : To authorize the People to appeal to an intermediate appellate court from an order precluding the introduction of evidence. SUMMARY OF PROVISIONS : Section 1 amends CPL 450.20(8) to authorize an appeal by the People to an intermediate appellate court from an order precluding the introduction of evidence. Section 2 Effective date. EXISTING LAW : Under current law, the People may appeal to an intermediate appellate court from an order suppressing evidence. VOLKER, MORAHAN -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the criminal procedure law, in relation to appeals from certain orders of suppression THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 8 of section 450.20 of the criminal procedure law is amended to read as follows: 8. An order suppressing evidence, entered before trial pursuant to section 710.20 OR 710.30; provided that the people file a statement in the appellate court pursuant to section 450.50. S 2. This act shall take effect immediately and shall apply to crimi- nal actions commenced on or after said effective date.
