BILL NUMBER: S2839 REVISED 04/01/09 TITLE OF BILL : An act to amend the labor law, in relation to informing potential contractors of responsibilities relating to hours, wages and supplements PURPOSE : The purpose of this bill is to inform all potential contractors, subcontractors or other persons bidding for public work Contracts of their responsibilities under section 220 of the Labor Law. SUMMARY OF PROVISIONS : Requires the Department of Labor to prescribe the form of a notice informing potential contractors of their responsibilities under section 220. Requires all contracting agencies to include such notice in the request for proposals for public work. JUSTIFICATION : Some confusion exists among contractors, especially contractors bidding on public work projects for the first time, as to their responsibilities under 220. Questions relating to hours, supplements and apprenticeship requirements arise frequently among both seasoned and new bidders, highlighting the need for published guidelines for rules on 220. STACHOWSKI -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT to amend the labor law, in relation to informing potential contractors of responsibilities relating to hours, wages and supple- ments THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 220 of the labor law is amended by adding a new paragraph (f) to read as follows: (F) IT SHALL BE THE DUTY OF THE DEPARTMENT OF JURISDICTION AS DEFINED IN THIS SECTION TO PRESCRIBE THE FORM OF A NOTICE INFORMING POTENTIAL CONTRACTORS, SUBCONTRACTORS OR OTHER PERSONS DOING OR CONTRACTING TO DO THE WHOLE OR A PART OF THE WORK CONTEMPLATED BY THE CONTRACT OF THEIR RESPONSIBILITIES UNDER THIS SECTION. THE STATE OR PUBLIC BENEFIT CORPO- RATION, OR A MUNICIPAL CORPORATION, OR A COMMISSION APPOINTED PURSUANT TO LAW, SHALL ANNEX TO AND FORM A PART OF, THE SPECIFICATIONS FOR THE WORK, SUCH NOTICE. SUCH STATE OR PUBLIC BENEFIT CORPORATION OR A MUNICI- PAL CORPORATION OR A COMMISSION APPOINTED PURSUANT TO LAW SHALL INCLUDE NOTICE AS TO THE TIME AND COMMENCEMENT OF THE ADVERTISEMENT FOR BIDS ON ALL PUBLIC WORK PROPOSED TO BE CONSTRUCTED.
