BILL NUMBER: S2890 TITLE OF BILL : An act to amend the transportation corporations law, in relation to prohibiting transportation corporations from placing power lines or power line towers near scenic byways PURPOSE : This legislation prohibits the use of eminent domain by transportation corporations for the purpose of the placement of power lines or power line towers within ten miles of a scenic byway. EXISTING LAW : This is new legislation. JUSTIFICATION : Scenic Byway designation is a rigorous State process built from the community level up. The process ultimately requires the approval of the State Department of Transportation, the Legislature, and the Governor of New York. Likewise, transportation corporations are organized under State law and are regulated under State law. The taking of land under State law to place power lines nearby a State designated scenic byway simply makes no sense. On one hand, State law is declaring the roadway and adjoining view to

BONACIC -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the transportation corporations law, in relation to prohibiting transportation corporations from placing power lines or power line towers near scenic byways THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The transportation corporations law is amended by adding a new section 7 to read as follows: S 7. PLACEMENT OF POWER LINES NEAR A SCENIC BYWAY. A CORPORATION ORGANIZED PURSUANT TO THIS CHAPTER SHALL NOT HAVE THE POWER AND AUTHORI- TY TO ACQUIRE SUCH REAL ESTATE AS MAY BE NECESSARY FOR ITS CORPORATE PURPOSES OR A RIGHT OF WAY THROUGH ANY PROPERTY IN THE MANNER PRESCRIBED BY THE EMINENT DOMAIN PROCEDURE LAW FOR THE PLACEMENT OF POWER LINES OR POWER LINE TOWERS WITHIN A TEN MILE RADIUS OF A SCENIC BYWAY AS DEFINED IN ARTICLE TWELVE-C OF THE HIGHWAY LAW.
