BILL NUMBER: S2926 TITLE OF BILL : An act to amend the public authorities law, in relation to appointing a Niagara county and St. Lawrence county resident to the power authority of the state of New York SUMMARY OF PROVISIONS : Section 1 amends section 1003 of the public authorities law, as amended by chapter 766 of the laws of 2005, in order to provide that the New York power Authority Board of Trustees contains one Trustee who resides in Niagara County, and one Trustee who resides in 8t. Lawrence County. PURPOSE AND JUSTIFICATION : The Niagara power Project is the biggest electricity producer in New York state and according to the New York Power Authority generates 2.4 million kilowatts - enough to light 24 million 100-watt bulbs at once. This low-cost electricity saves the state's residents and businesses hundreds of millions of dollars a year. However, the citizens of Niagara County have no representation on the Power Authorities Board of Trustees. The Franklin D. AUBERTINE -- read twice and ordered printed, and when printed to be committed to the Committee on Energy and Telecommuni- cations AN ACT to amend the public authorities law, in relation to appointing a Niagara county and St. Lawrence county resident to the power authority of the state of New York THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The opening paragraph of section 1003 of the public author- ities law, as amended by chapter 766 of the laws of 2005, is amended to read as follows: The authority shall consist of seven trustees, five of whom shall serve respectively for terms of one, two, three, four and five years, to be appointed by the governor, by and with the advice and consent of the senate. The sixth and seventh trustees shall be appointed by the gover- nor, by and with the advice and consent of the senate, and shall serve initial terms of one and two years respectively. ONE TRUSTEE SHALL BE A RESIDENT OF NIAGARA COUNTY AND ONE TRUSTEE SHALL BE A RESIDENT OF ST. LAWRENCE COUNTY. Each trustee shall hold office until a successor has been appointed and qualified. At the expiration of the term of each trustee and of each succeeding trustee the governor shall, by and with the advice and consent of the senate, appoint a successor, who shall hold office for a term of five years, or until a successor has been appointed and qualified. In the event of a vacancy occurring in the office of the trustee by death, resignation or otherwise, the governor shall, by and with the advice and consent of the senate, appoint a successor, who shall hold office for the unexpired term. Four trustees shall constitute a quorum for the purpose of organizing the authority and conducting the business thereof. S 2. This act shall take effect immediately.
