                                 BILL NUMBER:  S3032

 TITLE OF BILL :
An act to amend the vehicle and traffic law, in relation to
distribution of health care proxy information

 PURPOSE :
To establish a mechanism for the motor vehicle department to send
health care proxies and information in motor vehicle department
mailings to New York State residents regarding license and
registration renewals and for residents who first register vehicles.

 SUMMARY OF PROVISIONS :
The Vehicle and Traffic Law is amended to require the Department of
Motor Vehicles to include health care proxy forms and instructions
developed by the Department of Health to residents in mailings on
drivers' licenses and periodically in mailings on registrations.

 JUSTIFICATION :
Recent events related to end of life decisions have raised the
consciousness of New Yorkers regarding such matters. The need for
individuals to make their wishes concerning their health care known
under circumstances where such individual is incapable of making their
own end of life decisions is paramount to avoiding unecessary
litigation and family strife" People want to and should have their
health care wishes honored. Yet a large majority of New York residents

do not have a health care proxy. As a result, their health care wishes
are usually unknown and people are given medical treatment that they
would not want or not given treatment that they would want.

Therefore, it is important for the state of New York to establish a
variety of ways to provide individuals with health care proxy forms
and instructions for duly perfecting such proxies to increase the
number of people who complete this important document. It makes sense
to have the Department of Motor Vehicles, which periodically sends
mailings to many residents of the state, to include a health care
proxy form and instructions. This is consistent with what the
Department does now when it provides a place on driver's licenses for
organ donations.

AN ACT to amend the vehicle and traffic law, in relation to distribution
  of health care proxy information

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  vehicle  and  traffic law is amended by adding a new
section 397-c to read as follows:
  S 397-C. DISTRIBUTION OF HEALTH CARE PROXY INFORMATION. THE DEPARTMENT
SHALL DISTRIBUTE, IN LICENSE AND VEHICLE REGISTRATION  MAILINGS  TO  NEW
YORK RESIDENTS, A HEALTH CARE PROXY FORM AND INSTRUCTIONS AS PREPARED BY
THE  DEPARTMENT  OF  HEALTH  IN  COLLABORATION  WITH THE COMMISSIONER OF
HEALTH. THE DEPARTMENT SHALL CONDUCT SUCH MAILINGS FOR THE ENTIRE CALEN-
DAR YEAR ONCE EVERY FOUR YEARS. THE FIRST MAILING SHALL  COMMENCE  ON  A
SCHEDULE  TO  BE  DETERMINED  BY  THE COMMISSIONER, BUT MUST COMMENCE NO
LATER THAN JANUARY FIRST, TWO THOUSAND ELEVEN.
  S 2. This act shall take effect immediately.
