BILL NUMBER: S3043 TITLE OF BILL : An act to direct the New York state office of real property services to develop a program to determine eligibility for the enhanced STAR exemption without necessitating the collection of personal information by the assessor PURPOSE : To direct the Office of Real Property Services to develop a program to determine STAR eligibility without necessitating the collection of sensitive personal information by assessors. JUSTIFICATION : Assessors must currently collect certain sensitive personal information in order to verify eligibility for the enhanced STAR exemption. Income tax returns with social security numbers and other personal information are currently required to be submitted to the assessor for STAR eligibility determinations. In this day and age, when identity theft is a very real concern, the collection of sensitive personal information should be limited to the extent possible and should only be required in circumstances where extensive measures have been taken to ensure the security of sensitive personal information. JOHNSON, LARKIN, MORAHAN -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to direct the New York state office of real property services to develop a program to determine eligibility for the enhanced STAR exemption without necessitating the collection of personal information by the assessor THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law to the contrary, the New York state office of real property services is hereby directed to develop a program which provides for the determination of eligibility for the enhanced STAR exemption pursuant to subdivision 4 of section 425 of the real property tax law, without requiring the collection of personal information or documentation, including, but not limited to, social security numbers, income tax returns or other income verification information by the assessor.
