BILL NUMBER: S309 TITLE OF BILL : An act to amend the general municipal law, in relation to the period of validity of certificates attesting to the satisfactory completion of an approved police basic training program PURPOSE : To extend the time frame from which an individual may reenter work as a police officer, after he has left the continuous service of being a police officer. SUMMARY OF PROVISIONS : Amends section 209-q of the general municipal law to change from two to eight years the period of interruption an individual may have in service and remain certified as a municipal police officer when the individual has served less than two consecutive years. This section also extends from four to eight years the period of interruption an individual may have in service and remain certified as a municipal police officer when the individual has served more than two consecutive years. The section also extends from ten to fifteen years the amount of interruption of service allowable when an individual has met certain provisions. JUSTIFICATION :

MAZIARZ -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the general municipal law, in relation to the period of validity of certificates attesting to the satisfactory completion of an approved police basic training program THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (b) of subdivision 1 of section 209-q of the general municipal law, as amended by chapter 551 of the laws of 2001, is amended to read as follows: (b) A certificate attesting to satisfactory completion of an approved municipal police basic training program awarded by the executive direc- tor of the municipal police training council pursuant to this subdivi- sion shall remain valid: (i) during the holder's continuous service as a police officer or peace officer who has an equivalency certificate for police officer training or an approved course for state university of New York public safety officers issued in accordance with subdivision three of section eight hundred forty-one of the executive law; and (ii) for [two] TWELVE years after the date of the commencement of an interruption in such service where the holder had, immediately prior to such interruption, served as a police officer or peace officer who has an equivalency certificate for police officer training or an approved course for state university of New York public safety officers issued in accordance with subdivision three of section eight hundred forty-one of the executive law, for less than two consecutive years; or (iii) for [four] TWELVE years after the date of the commencement of an interruption in such service where the holder had, immediately prior to such interruption, served as a police officer or peace officer who has an equivalency certificate for police officer training or an approved EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
