BILL NUMBER: S339 TITLE OF BILL : An act to amend the alcoholic beverage control law, in relation to licenses to sell liquor for off-premises consumption near schools PURPOSE : To extend the zone around a school or place of worship, in which no premises may be granted a retail license to sell liquor and/or wine for off-premises consumption, to 350 feet on the same street. SUMMARY OF PROVISIONS : The bill prohibits the granting of retail licenses to sell liquor and/or wine for off-premises consumption to any premises located on the same street and within 350 feet of a building occupied exclusively as a school or place of worship. No license shall be denied to any premises where such a license has been in existence continuously since before the school or place of worship was occupied exclusively as such. EXISTING LAW : The bill amends subdivision 3 of section 105 of the alcoholic beverage control law, to extend the restricted zone from 200 feet to 350 feet. JUSTIFICATION :

KRUGER -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the alcoholic beverage control law, in relation to licenses to sell liquor for off-premises consumption near schools THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (a) of subdivision 3 of section 105 of the alco- holic beverage control law, as amended by chapter 406 of the laws of 2007, is amended to read as follows: (a) No retail license to sell liquor and/or wine for off-premises consumption shall be granted for any premises which shall be located on the same street or avenue, and within [two] THREE hundred FIFTY feet of a building occupied exclusively as a school, church, synagogue or other place of worship; the measurements to be taken in a straight line from the center of the nearest entrance to the building used for such school, church, synagogue or other place of worship to the center of the nearest entrance of the premises to be licensed; except, however, that no license shall be denied to any premises at which a license under this chapter has been in existence continuously from a date prior to the date when a building on the same street or avenue and within [two] THREE hundred FIFTY feet of said premises has been occupied exclusively as a school, church, synagogue or other place of worship. S 2. This act shall take effect immediately and shall apply to those licenses issued after such date.
