BILL NUMBER: S3606 TITLE OF BILL : An act to amend the insurance law, in relation to coverage for the treatment of lymphedema PURPOSE : To provide insurance coverage for the special bandages and oilier specialized necessities in the treatment of lymphedema SUMMARY OF PROVISIONS : Adds Insurance Law sections: §3216(26) §3221(15) §4303(ff) EXISTING LAW : Insurance companies are not consistently covering the necessary bandages, garments and other aids required in the treatment of lymphedema.

S T A T E O F N E W Y O R K ________________________________________________________________________ 3606 2009-2010 Regular Sessions I N S E N A T E March 25, 2009 ___________ Introduced by Sen. LAVALLE -- read twice and ordered printed, and when printed to be committed to the Committee on Insurance AN ACT to amend the insurance law, in relation to coverage for the treatment of lymphedema THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subsection (i) of section 3216 of the insurance law is amended by adding a new paragraph 26 to read as follows: (26) EVERY POLICY WHICH PROVIDES COVERAGE FOR LYMPHEDEMA SHALL INCLUDE COVERAGE FOR NECESSARY AIDS OR DEVICES FOR SUCH TREATMENT INCLUDING, BUT NOT LIMITED TO, COMPRESSION SLEEVES, GLOVES, GAUNTLETS AND OTHER GARMENTS. S 2. Subsection (k) of section 3221 of the insurance law is amended by adding a new paragraph 15 to read as follows: (15) A GROUP OR BLANKET ACCIDENT OR HEALTH INSURANCE POLICY OR ISSUING A GROUP OR BLANKET POLICY FOR DELIVERY IN THIS STATE WHICH PROVIDES COVERAGE FOR LYMPHEDEMA SHALL INCLUDE COVERAGE FOR NECESSARY AIDS OR DEVICES FOR SUCH TREATMENT INCLUDING, BUT NOT LIMITED TO, COMPRESSION SLEEVES, GLOVES, GAUNTLETS AND OTHER GARMENTS. S 3. Section 4303 of the insurance law is amended by adding a new subsection (ff) to read as follows: (FF) A MEDICAL EXPENSE INDEMNITY CORPORATION, A HOSPITAL SERVICE CORPORATION OR A HEALTH SERVICE CORPORATION WHICH PROVIDES COVERAGE FOR LYMPHEDEMA SHALL INCLUDE COVERAGE FOR NECESSARY AIDS OR DEVICES FOR SUCH TREATMENT INCLUDING, BUT NOT LIMITED TO, COMPRESSION SLEEVES, GLOVES, GAUNTLETS AND OTHER GARMENTS. S 4. This act shall take effect on the first of January next succeed- ing the date on which it shall have become a law and shall apply to all policies or contracts issued, renewed, modified, altered or amended on and after such effective date.
