Provides that no class or any other course of instruction shall be held in any institution within the state or city university on those days of religious observance known as Rosh Hashanah or Yom Kippur provided, however, that the chancellor, in his discretion, may exempt any institution from such observance.

BILL NUMBER: S3925 TITLE OF BILL : An act to amend the education law, in relation to observance of certain holidays by institutions within the state university and the city university of New York PURPOSE OR GENERAL IDEA OF BILL : To prohibit the scheduling of classes on the days of religious observance known as Rosh Hashanah and Yom Kippur. SUMMARY OF SPECIFIC PROVISIONS : Section 1 of the bill adds a new section 361 to the education law, stating that no class or any other course shall be held within the SUNY system on Rosh Hashanah and Yom Kippur. Section 2 of the bill adds a new section 6235 of the education law, stating that no class or any other course shall be held within the CUNY system on Rosh Hashanah and Yom Kippur. JUSTIFICATION : Scheduled classes and laboratories on holy days produce a strain and hardship on both students and faculty. In the case of laboratories which are progressive, it is particularly difficult to make up the missed labs. The difficulty is increased because academic activity of

JOHNSON, MONSERRATE, ONORATO, SAVINO, SCHNEIDERMAN, THOMPSON -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to observance of certain holidays by institutions within the state university and the city university of New York THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 361 to read as follows: S 361. HOLIDAYS TO BE OBSERVED. NO CLASS OR ANY OTHER COURSE OF INSTRUCTION SHALL BE HELD IN ANY INSTITUTION WITHIN THE STATE UNIVERSITY ON THOSE DAYS OF RELIGIOUS OBSERVANCE KNOWN AS ROSH HASHANAH OR YOM KIPPUR PROVIDED, HOWEVER, THAT THE CHANCELLOR, IN HIS OR HER DISCRETION, MAY EXEMPT ANY INSTITUTION FROM THE FOREGOING PROVISIONS OF THIS SECTION.
