BILL NUMBER: S3969 TITLE OF BILL : An act to amend the tax law, in relation to exempting from sales and use taxes sanitary napkins and tampons SUMMARY OF PROVISIONS : Amends subdivision (a) section eleven hundred fifteen of the tax law by adding a new paragraph four-a that would exempt sanitary napkins and tampons from the tax on retail sales. JUSTIFICATION : There are many specialized, non-prescription, health related items which people choose to use to relieve assorted discomforts such as contact lens cleaning and soaking preparations, ace bandages, laxatives, and sterile cotton to name but a few. Women have no choice in their need for sanitary napkins and must purchase them. These non-optional items are an important aspect in the health maintenance of women. OPPENHEIMER -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Government Operations AN ACT to amend the tax law, in relation to exempting from sales and use taxes sanitary napkins and tampons THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision (a) of section 1115 of the tax law is amended by adding a new paragraph 4-a to read as follows: (4-A) SANITARY NAPKINS AND TAMPONS. S 2. This act shall take effect on the first of September next succeeding the date on which it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD09264-01-9
