BILL NUMBER: S4099 TITLE OF BILL : An act to amend the public authorities law, in relation to reimbursing Medicare Part B premium payments made by retirees of the metropolitan transportation authority and its subsidiary corporations PURPOSE : This bill would allow the retirees of the Metropolitan Transportation Authority and its subsidiaries including their dependents, to be reimbursed the cost for premiums for the retirees enrolled in the Medicare program as added by Title XVII of the 1965 amendment to the Social Security Act. SUMMARY OF PROVISIONS : Public Authorities Law is amended by adding a new section 1266-i EXISTING LAW : Currently, retired members of the New York City Employees' Retirement System (NYCERS) receive 100% reimbursement for the costs of premiums associated under Medicare Part B, but retirees of the Metropolitan Transit Authority (MTA) and its subsidiaries do not. MTA retirees only receive a 50% reimbursement. JUSTIFICATION :

BOYLAND, TOWNS -- read once and referred to the Committee on Corporations, Authorities and Commissions AN ACT to amend the public authorities law, in relation to reimbursing Medicare Part B premium payments made by retirees of the metropolitan transportation authority and its subsidiary corporations THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public authorities law is amended by adding a new section 1266-i to read as follows: S 1266-I. HEALTH INSURANCE COVERAGE FOR EMPLOYEES OF THE AUTHORITY OR OF ANY OF ITS SUBSIDIARIES, PERSONS RETIRED FROM SUCH EMPLOYMENT, AND DEPENDENTS OF SUCH EMPLOYEES AND RETIREES. 1. AS USED IN THIS SECTION, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS: (A) "MTA EMPLOYEE" SHALL MEAN A PERSON WHO IS EMPLOYED BY THE AUTHORI- TY OR ANY OF ITS PUBLIC BENEFIT SUBSIDIARY CORPORATIONS. (B) "MTA RETIREE" SHALL MEAN A PERSON WHO: (1) IS RECEIVING A RETIREMENT ALLOWANCE, PENSION OR OTHER RETIREMENT BENEFIT FROM A RETIREMENT OR PENSION SYSTEM TO WHICH THE AUTHORITY OR ONE OF ITS PUBLIC BENEFIT CORPORATION SUBSIDIARIES HAS MADE CONTRIB- UTIONS ON BEHALF OF SUCH PERSON; (2) IMMEDIATELY PRIOR TO SUCH PERSON'S RETIREMENT AS A MEMBER OF SUCH SYSTEM WAS AN MTA EMPLOYEE; AND (3) HAD AT THE TIME OF RETIREMENT AT LEAST FIVE YEARS OF CREDITED SERVICE AS A MEMBER OF SUCH RETIREMENT OR PENSION SYSTEM, EXCEPT THAT EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
