BILL NUMBER: S434 TITLE OF BILL : An act to amend the public health law, in relation to the early rate restructuring work group and early intervention demonstration projects PURPOSE : This legislation would direct the Commissioner of Health, in consultation with the Commissioner of the Office of Mental Retardation and Developmental Disabilities, to establish an early intervention rate restructuring work group to review and make recommendations for a redesign of the reimbursement system for early intervention services, to report to the legislature and prepare for implementation of a redesigned reimbursement system. The bill also directs the Commissioners to develop and disseminate an RPF to establish early intervention demonstration projects so that children with multiple services needs can receive services in a comprehensive, coordinated, collaborative, family-centered approach and explore alternative services delivery and reimbursement models. SUMMARY OF PROVISIONS : Sections one of the bill creates two new sections 2555 and 2555-a of the public health creating the early intervention rate restructuring work group, directing the commissioners to collect data on early intervention providers and to report to the legislature on the work

MORAHAN -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to the early rate restructuring work group and early intervention demonstration projects THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding two new sections 2555 and 2555-a to read as follows: S 2555. EARLY INTERVENTION RATE RESTRUCTURING WORK GROUP. THE COMMIS- SIONER IS DIRECTED, IN CONSULTATION WITH THE COMMISSIONER OF THE OFFICE OF MENTAL RETARDATION AND DEVELOPMENTAL DISABILITIES, TO COLLECT INFOR- MATION ON REVENUES AND EXPENSES OF EARLY INTERVENTION SERVICE PROVIDERS AND TO ESTABLISH A WORK GROUP TO REVIEW THE FISCAL DATA COLLECTED AND RECOMMEND, WHERE APPROPRIATE, A REDESIGN OF THE REIMBURSEMENT SYSTEM FOR EARLY INTERVENTION SERVICES. FOR APPROVED EARLY INTERVENTION PROVIDERS REQUIRED TO SUBMIT A CONSOLIDATED FISCAL REPORT (CFR) TO ANOTHER STATE AGENCY OR DEPARTMENT, SUCH AGENCY OR DEPARTMENT SHALL FORWARD TO THE DEPARTMENT SUCH RELEVANT CFR INFORMATION AS MAY BE REQUESTED. FOR APPROVED EARLY INTERVENTION PROVIDERS NOT REQUIRED TO FILE A CFR WITH ANOTHER STATE DEPARTMENT OR AGENCY, THE COMMISSIONER SHALL REQUIRE SUCH INFORMATION AS NECESSARY FOR COMPARABILITY TO CFR INFORMATION. THE WORK GROUP SHALL INCLUDE, BUT NOT BE LIMITED TO, REPRESENTATIVES OF MUNICI- PALITIES AS WELL AS STATEWIDE AND REGIONAL REPRESENTATIVES OF PROVIDERS OF EARLY INTERVENTION SERVICES. THE COMMISSIONER SHALL REPORT TO THE LEGISLATURE, NO LATER THAN MARCH THIRTY-FIRST, TWO THOUSAND TEN, THE FINDINGS AND RECOMMENDATIONS OF THE WORK GROUP AND SHALL PREPARE FOR IMPLEMENTATION OF THE REDESIGNED REIMBURSEMENT SYSTEM EFFECTIVE FOR THE JULY FIRST, TWO THOUSAND TEN PROGRAM YEAR.
