BILL NUMBER: S4556 TITLE OF BILL : An act to amend the transportation law, in relation to the erection of certain towers on special parkway lands PURPOSE OR GENERAL IDEA OF BILL : This bill prohibits the commissioner of transportation to grant any erection of communication towers/cell towers on special parkway lands without the consent of the local government in which such lands are located. SUMMARY OF SPECIFIC PROVISIONS : Amends the transportation law by adding a new section 71-a that states the commissioner shall not erect, cause or permit to be erected, grant easements or licenses for, or facilitate the erection of any tower on special parkway lands, including cellular/PCS towers, without the consent of the local government in which such lands are located. This shall conform in all respects to any and all local laws, ordinances, resolutions, rules, and regulations. "Special Parkways" are parkways located in Westchester County, including the Hutchinson River Parkway, the Saw Mill River Parkway, the Cross County Parkway, the Taconic Parkway, and the Sprain Brook Parkway.

OPPENHEIMER -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the transportation law, in relation to the erection of certain towers on special parkway lands THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The transportation law is amended by adding a new section 71-a to read as follows: S 71-A. SPECIAL PARKWAYS; ERECTION OF TOWERS. NOTWITHSTANDING ANY INCONSISTENT PROVISION OF LAW, THE COMMISSIONER SHALL NOT ERECT, CAUSE OR PERMIT TO BE ERECTED, GRANT EASEMENTS OR LICENSES FOR, OR OTHERWISE FACILITATE THE ERECTION OF, ANY TOWER, INCLUDING BUT NOT LIMITED TO ANY TOWER USED FOR TELECOMMUNICATIONS, CELLULAR TELEPHONE, POLICE, OR OTHER EMERGENCY OR PUBLIC SERVICES COMMUNICATIONS, SATELLITE COMMUNICATIONS, OR DIGITAL OR PCS COMMUNICATIONS, ON LANDS OF ANY SPECIAL PARKWAY WITH- OUT THE CONSENT OF THE CITY, TOWN, OR VILLAGE IN WHICH SUCH LANDS ARE LOCATED. ANY SUCH USE SHALL CONFORM IN ALL RESPECTS TO ANY AND ALL LOCAL LAWS, ORDINANCES, RESOLUTIONS, RULES, AND REGULATIONS. S 2. This act shall take effect immediately.
