BILL NUMBER: S459 TITLE OF BILL : An act to amend the executive law, in relation to contracts for neighborhood crime prevention activities SUMMARY OF BILL : This bill would extend the current 5 year aggregate cap on local agency eligibility for funding under the Neighborhood Preservation Crime Prevention Act (NPCPA) to an aggregate of ten (10) years. Contracts between the Division of Criminal Justice Services (DCJS) and local not-for-profit community groups would still be limited to 1 year and would be renewable at the discretion of the Commissioner of DCJS. JUSTIFICATION : Currently, contracts under NPCPA are limited to one year in duration and are renewable by the Commissioner of DCJS, at his/her discretion, for up to an aggregate of four additional one-year periods. The unfortunate consequence of this arbitrary 5 year cap is that programs that are in place and working well face extinction after 5 years. This legislation would leave to the discretion of the Commissioner, who periodically evaluates said programs, the ability to provide continued funding to successful neighborhood crime prevention programs, for up to an additional 9 years.

KRUGER -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law, in relation to contracts for neigh- borhood crime prevention activities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 4 of section 846-c of the executive law, as amended by chapter 854 of the laws of 1984, is amended to read as follows: 4. Contracts entered into hereunder with companies shall be limited in duration to periods of one year, but may thereafter be renewed, extended, or succeeded by new contracts from year to year in the discretion of the commissioner for up to an aggregate of [four] NINE additional years. Contract awards shall be limited in amount to the sum of sixty thousand dollars in a single year. Each company shall also define with particularity the neighborhood or portion thereof within which the company's activities shall be performed under such contract. The contract shall also set forth the company's obligations to provide training in approved crime prevention techniques, and in community relations, to those who shall perform crime prevention activities for the company.
