2009-S462 (ACTIVE) - Summary
Provides that 25% of the amount of any rental surcharge paid by a tenant of a limited-profit (Mitchell-Lama) housing company project shall be deemed to have been directly imposed on the tenant by the municipality for real estate taxes and/or mortgage interest and to have been directly paid by the tenant to the municipality for such purposes.

BILL NUMBER: S462 TITLE OF BILL : An act to amend the private housing finance law, in relation to rental surcharges in certain cases SUMMARY : This bill would add a new subdivision 4-a to the Private Housing Finance Law § 31 to provide that twenty-five percent of the amount of any rental surcharge paid by a tenant shall be deemed to have been directly imposed on such tenant by the municipality for real estate taxes and/or mortgage interest for which the housing company has otherwise been subsidized and directly paid by such tenant to the municipality for such purposes; notwithstanding that such surcharges have been collected by the housing company and partially remitted to the municipality. FISCAL IMPLICATION : To be determined. EFFECTIVE DATE : This act shall take effect immediately.

KRUGER -- read twice and ordered printed, and when printed to be committed to the Committee on Housing, Construction and Community Development AN ACT to amend the private housing finance law, in relation to rental surcharges in certain cases THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 31 of the private housing finance law is amended by adding a new subdivision 4-a to read as follows: 4-A. TWENTY-FIVE PERCENT OF THE AMOUNT OF ANY RENTAL SURCHARGE PAID BY A TENANT SHALL BE DEEMED TO HAVE BEEN: (A) DIRECTLY IMPOSED ON SUCH TENANT BY THE MUNICIPALITY FOR REAL ESTATE TAXES AND/OR MORTGAGE INTEREST FOR WHICH THE HOUSING COMPANY HAS OTHERWISE BEEN SUBSIDIZED; AND (B) DIRECTLY PAID BY SUCH TENANT TO THE MUNICIPALITY FOR SUCH PURPOSES.
