BILL NUMBER: S50436 TITLE OF BILL : An act to amend the tax law, in relation to extending the authorization of the county of Delaware to impose an additional one percent of sales and compensating use taxes PURPOSE OR GENERAL IDEA OF BILL : To authorize the County of Delaware to set their own sales tax rate up to 4%. SUMMARY OF SPECIFIC PROVISIONS : Caps Delaware County's local sales tax at 4% by allowing that County's Board of supervisors to impose a sales tax of not more than that percent through November 30, 2011. EFFECTS OF PRESENT LAW WHICH THIS BILL WOULD ALTER : Would change the date from November 30, 2009 to November 30, 2011. JUSTIFICATION : Delaware County has requested this legislation. S T A T E O F N E W Y O R K ________________________________________________________________________ 436 Extraordinary Session I N S E N A T E June 23, 2009 ___________ Introduced by COMMITTEE ON RULES -- (at request of the Governor) -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the tax law, in relation to extending the authorization of the county of Delaware to impose an additional one percent of sales and compensating use taxes THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Clause 34 of subparagraph (i) of the opening paragraph of section 1210 of the tax law, as amended by chapter 563 of the laws of 2007, is amended to read as follows: (34) the county of Delaware is hereby further authorized and empowered to adopt and amend local laws, ordinances or resolutions imposing such taxes at a rate that is one percent additional to the three percent rate authorized above in this paragraph for such county for the period begin- ning December first, two thousand three, and ending November thirtieth, two thousand [nine] ELEVEN; S 2.
