Requires paper ballots have a box, oval or other marking area that the voter may intentionally fill in to alert the voting system that any and all undervotes on the ballot have been done so intentionally; allows the system to cast the ballot without returning an "undervote error message" to the voter.

BILL NUMBER: S5112 TITLE OF BILL : An act to amend the election law, in relation to the form of paper ballots PURPOSE OR GENERAL IDEA OF THE BILL : This bill would require ballots to provide an area to be filled in by a voter that would notify the voting system that the voter intended to undervote deliberately and as such no error notice should not be produced. SUMMARY OF PROVISIONS : Adds a new subdivision 11 to section 7-106 of the election law stating that ballots must provide an area to be filled in by a voter that would notify the voting system that the voter intended to undervote deliberately and as such no error notice should not be produced. JUSTIFICATION : When paper ballots are used and not filled out entirely it is possible for a voter to receive an error message even though they voted correctly, the reason this error message happens is because they did not vote on every race. Many times an individual chooses to not vote on a specific race and they should not receive such a message. This legislation will provide for a way for such a voter to provide their

FOLEY -- read twice and ordered printed, and when printed to be committed to the Committee on Elections AN ACT to amend the election law, in relation to the form of paper ballots THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 7-106 of the election law is amended by adding a new subdivision 11 to read as follows: 11. BALLOTS SHALL PROVIDE FOR A BOX, OVAL OR OTHER MARKING AREA, WHICH WHEN FILLED IN BY A VOTER, SHALL BE RECOGNIZED BY THE VOTING SYSTEM AS A DIRECTIVE FROM THE VOTER INDICATING THAT ANY RACES ON THE BALLOT THAT HAVE BEEN UNDERVOTED HAVE BEEN SO UNDERVOTED DELIBERATELY, AND AS SUCH, THE VOTING SYSTEM SHALL NOT PRODUCE AN UNDERVOTE ERROR NOTICE TO THE VOTER.
